<br />Council recessed at 8:04 p.m. and reconvened at 8: 10 p.m. <br /> <br />VII. COUNCIL BUSINESS <br /> <br />1. Pheasant Marsh Phase II Developer's Agreement <br /> <br />City Attorney Hoeft reviewed the Developer's Agreement with Council. <br /> <br />Mayor Sweeney indicated he was concerned with the last paragraph of the Ground <br />Development attorney's letter. City Attorney Hoeft indicated it concerned him too and <br />he would discuss it with the other attorney, but clarified that the City has every right to <br />request higher park dedication fees if asked to bring property into MUSA ahead of when <br />it would have come in because common sense would indicate that the fees would be <br />higher five years later. <br /> <br />Mayor Sweeney indicated he would like Ground Development to understand the rationale <br />behind the higher park dedication fees. City Attorney Hoeft indicated that he would <br />communicate to Ground Development that all costs associated with advancing MUSA for <br />the property would be born by Ground Development and would not involve the City. <br /> <br />2. NPDES Phase II MS4 Permit <br /> <br />Ms. Moore-Sykes indicated that Staff continues to work on the NPDES Phase II MS4 <br />permit. <br /> <br />Mayor Sweeney indicated that the draft provided, listed the storm water fee incorrectly <br />and asked that Staff go through the document and provide updated fee information. <br /> <br />Council Member Capra asked that Staff verify the water quality designation for <br />Centerville Lake. <br /> <br />3. Resolution #03-015 - Fee Schedule (Amending Resolution #03-002) <br /> <br />Ms. Moore-Sykes indicated that Staff determined that the City's Fee Schedule did not <br />include a license fee for an adult establishment and this Resolution would amend the Fee <br />Schedule to include that. <br /> <br />Motion by Council Member Broussard Vickers. seconded by Council Member <br />Capra to approve Resolution #03-015. a Resolution amendinl! the Fee Schedule. All <br />in favor. Motion carried unanimously. <br /> <br />4. Parks & Recreation Committee Recommendations <br /> <br />Council Member Lee indicated there is a motion that is missing from the agenda and it <br />was in regard to a Parks and Recreation recommendation concerning Hunter's Crossing. <br /> <br />Page 11 of17 <br />
