City ofCenterville Council Meeti08 Minutes April 10, 2002 city Attorney Hoeft indicated that changes to ~ ordinance should be brought forward and discussed at the public hearing. He then said the changes seemed pretty straightforward andt ifnecessaryt he would work with Staff to amend the ordinance. Mayor Swedberg connnented that the City bas money sitting in a fund and asked what the City is to do with that money. City Attorney Hoeft indicated the City does not need to have the l00A rule in its ordinance in order for a charitable organ17.ation to donate l00A to the City. He then said the issue is once the money comes to the City what can it be used for. Council Member Capra indicated she had discussed lawful use of the money with Alice Jacobs and Ms. Jacobs was concerned after reviewing the minutes from the last meeting because it appeared that the Spring Lake Park Lions were giving money to Centervil1e for a project for the Centerville Lions and that the Cent~ Lions felt they had entitlement to those funds. Council Member Broussard Vickers indicated that the Centervi1le Lions want the money spent on a facility in the park for the benefit of the City not for the Lions. Council Member Nelson connnented that the City never said it wanted to build a concession stand in LaMotte Park. Council Member Broussard Vickers indicated that at the time this situation began it was the intent to construct a concession stand at the park. She then said the City could give the funds to the 50lC3 corporation allowing the Lions to use the funds to build the park shelter. Mayor Swedberg connnented that no other residents bad come to meet with the Anoka County Board of Review and suggested closing the public hearing. Motion by Council MeDlber Broussard Vieke.,.. seconded bv Council Member Nelson to close the Anoka County Board of Review public hearin2. AU in favor. Motion earried unaniDlously. Mayor Swedberg closed the public hearing at 7:00 p.m. City Attorney Hoeft advised that the money was donated to the City and from a legal standpoint the City may determine how that money is used. He further commented that it may be a good idea to respect the wishes of the person or entity donating funds to the City if the City wants to continue to receive donations but noted the City is not obligated to do so. He also connnented that there may have been an underst.mvJiTlg of how those funds would be spent and the additional step of trying to give recognition to the eenterville Lions bas muddied up the waters.
