<br />City Council 2008-09-10, 7:45 p.m. <br />Minutes of Work Session <br /> <br />~@~ &~~~@\"l@~ <br /> <br />Present were Mayor Capra, Council members Jeff Paar, Tom Lee, Linda Broussard- <br />Vickers, and Michelle Lakso. Also present were Mark Statz of Bonestroo & Assoc. and <br />City Attorney Kurt Glaser, <br /> <br />City Code: <br /> <br />The City Attorney reviewed proposed changes to City Code Section 91.05 prohibiting <br />transportation of controlled substances or drug paraphernalia and amending Section <br />111.22 by prohibiting "ultimate fighting" in any liquor establishment. <br /> <br />The Attorney reviewed a list of minor changes to Chapters 110-121, including the <br />proposal to require egress windows in all bedrooms of any residential rental unit. The <br />remaining Chapters 150-156 will be reviewed in a joint session with Planning & Zoning <br />on September 17, 2008. <br /> <br />Assessment Policy: <br /> <br />City Administrator Larson reviewed the assessment policy as it relates to comer lots and <br />odd-shaped lots involved in the 2009 Street Improvement. It was clear that some lots <br />would need further adjustment to get to an actual measure of benefit. The City will <br />engage the services of an appraiser to review a representative sampling of the unusual <br />lots to make sure we get a proper assessment on the parcels. <br /> <br />2009 Street Project Issues: <br /> <br />Mark Statz reviewed the schedule and suggested that bids be received in late October and <br />that the Council take action in early November to schedule a special assessment hearing <br />in early December. The Council will consider a special meeting on November 5 to call <br />for a public hearing. The hearing will likely be December 1. <br /> <br />Engineer Statz reviewed the plans for the project especially noting locations of rain <br />gardens. Almost all of the rain gardens will fit in the right of way or city utility <br />easements. Staff suggested a policy that rain gardens would be grass unless adjoining <br />property owner requests a flowered rain garden, in which case an agreement would be <br />executed that requires maintenance by the property owner. The engineer will meet with <br />property owners affected by rain gardens to explain the program. <br /> <br />The Council reviewed a map of drainage issues that are proposed to be addressed in the <br />project plan. The ponds in Acorn Creek and Acorn Creek Second Addition would be <br />cleaned. Rear-yard drainage issues would be corrected by installation of drain tile in <br />Hardwood Ponds 2nd Addition and Acorn Creek between Quebec and 73rd Avenue. The <br />consensus was to include the work in the project, with the costs paid from the Stormwater <br />Drainage Fund. <br />
