J 9 <br /> <br />~ 154.016 NONCONFORMING USES AND STRUCTURES. <br /> <br />Any structure or use existing upon the effective date of the adoption of this chapter <br />which does not conform to the provisions of this chapter may be continued, subject to the <br />following conditions: <br /> <br />(A) The nonconforming use is not expanded or enlarged, except in conformity with <br />the provisions of this chapter; <br /> <br />(B) If a nonconforming use is discontinued or a nonconforming structure is <br />abandoned for a period of 12 months, further use of the structure or property must <br />conform to this chapter; <br /> <br />(C) If a nonconforming use is replaced by another use, the new use shall conform to <br />this chapter; <br /> <br />(D) If a nonconforming use or structure is damaged by any cause to the extent that <br />repair or replacement costs exceed 50 percent of the market value, the use or structure <br />may not be replaced or repaired except in conformity with this chapter; <br /> <br />(E) A structure that consists of a one-family or two-family dwelling that is a lawful <br />non-conforming use located in a Business District or Industrial District may, upon being <br />damaged to an extent exceeding 50 percent of its fair market value, be repaired to its <br />preexisting condition, provided that the non-conformity does not also include <br />inconsistencies with the regulations of food-plains or shoreland protection.
