<br />to Licensee upon Licensee's failure to comply with any of the terms and conditions oftbis License <br />Agreement <br /> <br />S. ACCURACY OF INFORMATIONIWARRANTY <br /> <br />a. The infonnation furnished through and compiled in the GIS Data Base shall <br />be obtained from Licensor's records and is believed to be reliable. However, the accuracy, <br />completeness, timeliness, or correctness of the infonnation is not guaranteed by the Licensor. <br /> <br />b. The Licensor is furnishing the GIS Data Base on an "as is" basis without any <br />support whatsoever and without representation or warranty, including, but not in any manner limited <br />to, fitness, merchantability, and completeness of the GIS Data Base. <br /> <br />c. The Licensee agrees that the Licensor shall have no liability, contingent or <br />otherwise, for the accuracy, completeness, or correctness of the data or for any decision made or <br />action taken by the Licensee or anyone using information from the Licensee and acts in reliance <br />upon the data contained in the GIS Data Base. <br /> <br />d. There is no warranty of merchantability, no warranty of fitness for a particular <br />use, and no warranty of any kind, express or implied, regarding the accuracy or reliability of the <br />information contained in the GIS Data Base for any aspect of the Licensor's services provided <br />herein. <br /> <br />6. INDEMNIFICATION <br /> <br />The Licensee shall defend, indemnify, and save the Licensor harmless from any <br />liability, claims, damages, judgments, costs (including reasonable attorney fees), demands, or <br />actions arising, directly or indirectly, related to obtaining, use, and/or possession and utilization of <br />the GIS Data Base provided herein; and from a1l108s or liability by reason of fai lure of the Licensee, <br />in any respect. to perform fully or observe all obligations under this License Agreement. <br /> <br />7. GEOGRAPHIC INFORMATION SYSTEM DATA BASE (GIS DATA BASE) <br /> <br />The GIS Data Base is neither legally recorded maps or surveys and is not intended to <br />be used that way. The GIS Data Base is a compilation of records, information, and data from <br />various city, county, state, and federal offices and other sources and should be used for reference <br />only. No representation is made that the features contained in GIS Data Base accurately reflect true <br /> <br />-4. <br />
