<br />The City Council of Centerville, Minnesota met in a closed session on Wednesday, <br />October 12, 2005, at 6:30 p.m. in City Hall. Present were Mayor Mary Capra, Council <br />members Richard Terway, Michelle Lakso, Tom Lee and Jeff Paar. Also present were <br />Administrator Dallas Larson and Jim Hoeft & Joan Quade of City Attorney's office. The <br />purpose of the closed meeting was to hear a proposal for settidem relating to the lawsuit <br />with Royal Oaks Realty, Inc. and to review the status ~ . relating to Ronald S. <br />Hugger and related vehicle forfeiture. ~I n r u <br /> <br />Joan Quade reported that th g IE: filed a Rule 68 settlement offer of <br />$50,000. This means that if_awar were less than $50,000 the opposing party <br />could be awarded their costs. The Council was not interested in settling for such a low <br />amount, especially given that we are now prepared for trial. The attorney reviewed the <br />procedures that will be followed by the court and noted that it is likely the council <br />members that have been subpoenaed can be excused by the judge until their testimony is <br />required. The notice will be posted of a special meeting at 9:00 a.m. at the Court House. <br /> <br />Jim Hoeft reported that the attorney for Ronald Hugger has asked that his client be paid <br />the value of the vehicle that was forfeited in error and sold to Lexington Fire Department. <br />Since the proceeds of sale went to the Centennial Lakes Police Department, any refund <br />should be paid from Police Department Funds. This will need to be approved by the <br />Joint Powers Governing Board.
