<br />11. CONDITIONS FOR RELIGIOUS ORGANIZATIONS <br />The Agency agrees that funds provided under this contract will not be utilized for religious activities, to <br />promote religious interests, or for the benefit of a religiolJs organization in accordance with the Federal <br />regulations specified in 24 CFR 570.2000). <br /> <br />12. NATIONAL FLOOD INSURANCE <br />The Agency may not receive Community Development Block Grant funding for acquisition or construction for <br />use' in any area that has been identified as having special flood hazards and is not participating in the <br />National Flood Insurance Program, as provided by Section 3(a) ofthe Flood Disaster Protection Act of 1973 <br />(Pub. L.93- 234) and the Regulations thereunder (24 CFR Ch. 58.6, sub chap. B). The Agency shall comply <br />with the Regulations at 24 CFR section 570.605. <br /> <br />13. AIR AND WATER POLLUTION <br />The Agency shall comply with the provisions of the Clean Air Act, as amended (42 USC section 1857 et <br />~ and the Federal Water Pollution Control Act, as amended (33 USC sections 1251 et ~ and the <br />regulations issued thereunder (40 CFR pt. 15). <br /> <br />14. LEAD-BASED PAINT POISONING <br />The Agency shall comply with the HUD Lead-Based Paint Regulations (24 CFR pt. 35) issued pursuant to <br />the Lead-Based Paint Poisoning Prevention Act (42 USC sections 4831 et m) requiring (1) prohibition of <br />the use of lead-based paint (whenever funds under this Agreement are used directly or indirectly for <br />construction, rehabilitation, or modernization of residential structures); (2) elimination of immediate <br />lead;;.basedpaint hazards in residential structures; and (3) notification of the hazards of lead-based paint <br />. ,'poisoning.to purehasers and tenants of residential structures constructed prior to 1978. <br /> <br />:-. , .; :";.,' "':' <br /> <br />All work performed on lead-containing surfaces must conform to lead-safe practices and be comp.leted by <br />workers who are either supervised by an EPA-certified abatement supervisor or be performed by workers <br />: trajhe(rihlead~safe work practices. If abatement options are specified in the work write-up, the contractor <br />. .. . musthirean EPA-certified and state-licensed abatement contractor and submit proof of their current ~tate <br />.. ;' ljoenseand insurances. <br /> <br />.' ,;'. ~. .,;~ <br /> <br />15~ NON-DISCRIMINATION BASED ON DISABILITY <br />When and where applicable, the agency shall comply with Section 504 of the Rehabilitation Act of 1973, as <br />amended (29 U.S.C. 794) and Title II of the Americans with Disabilities Act as amended, Public Law 101- <br />336 (1990), to ensure that no otherwise qualified individual with a disability in the United States shall, solely <br />by reason of his or her handicap, be excluded from participation in, be denied the benefits of, or be <br />subjected to discrimination under any program or activity receiving financial assistance under this <br />agreement. <br /> <br />16. NON-SUBSTITUTION FOR LOCAL FUNDING <br />The Block Grant Funding made available under this Agreement shall not be utilized by the Agency to reduce <br />substantially the amount of local financial support for community development activities below the level of <br />such support prior to the availability of funds under this Agreement. <br /> <br />17. PUBLIC OWNERSHIP <br />For Agencies which are not municipal corporations organized under the laws of the State of Minnesota, it <br />may become necessary to grant the County a' property interest where the subject project calls for the <br />acquisition, construction, reconstruction, rehabilitation, or installation of publicly-owned facilities and <br />improvements. The Agency shall comply with current County policy regarding transfer of a property interest <br />sufficient to meet the public ownership requirement. <br /> <br />-10- <br /> <br />&/ <br />
