City of Centerville <br />Special Council Meeting Minutes <br />October 24, 2005 <br />VIII. EXECUTIVE SESSION (CLOSED) <br />Royal Oaks Realty Litigation <br />9: 10 a.m. <br /> – Mayor Capra recessed the council to executive session for discussion of settlement <br />with Royal Oaks Realty. <br />9:30 a.m <br />. – Mayor Capra reconvened the regular session of the meeting. During the executive <br />session the council discussed a settlement offer to be presented to Royal Oaks Realty by the <br />attorney representing the City of Centerville, Ms. Quade in the amount of $80,000.00 payable <br />today. <br />Motion by Council Member Lee seconded by Council Member Paar to offer a settlement <br />amount of $80,000.00 to Royal Oaks Realty payable today. All in favor. Motion carried <br />unanimously. <br />9:45 a.m. <br /> – Mayor Capra recessed the special meeting and council moved into the courtroom. <br />10:10 a.m. – <br />Mayor Capra reconvened the special meeting and recessed to executive session for <br />settlement negotiation with Mr. Marcel Eibensteiner of Royal Oaks Realty per the request of <br />Judge Maas. <br />10:41 a.m. <br />– Mayor Capra reconvened the special meeting. During the executive session the <br />council discussed with Mr. Marcel Eibensteiner a settlement of $65,000.00 to be paid by cashier <br />check to the City of Centerville no later than Wednesday, October 26, 2005 before the close of <br />the business day. The City of Centerville would dismiss the case following the receipt of the <br />check. <br />Motion by Council Member Paar seconded by Council Member Lee to offer a settlement <br />amount of $65,000.00 to Royal Oaks Realty payable in the form of a cashier check to the <br />City of Centerville by close of business day Wednesday, October 26, 2005. Once the City <br />has the payment has been received the City of Centerville will move that the case against <br />Royal Oaks Realty will be dismissed. All in favor. Motion carried unanimously. <br />IX. NEW BUSINESS <br />X. ADJOURNMENT <br />Motion by Council Member Lee seconded by Council Member Paar to adjourn the <br />October 24, 2005 City Council Special Meeting at 10:43 a.m. All in favor.
