SUPERSEDING EASEMENT The City of Centerville, a body corporate and political subdivision of the State of Minnesota ("Grantor"), hereby conveys a perpetual easement to the Rice Creek Watershed District, a political subdivision of the State of Minnesota with powers set forth at Minnesota Statutes Chapters 103B and 103D and the drainage authority for Anoka County Ditch 55 pursuant to Chapter 103E ("Grantee"), and Grantee hereby releases and terminates that prior easement over real property owned by Grantor and Sheehy Construction Co., a Minnesota corporation ("Sheehy"), under the terms set forth herein. WITNESSETH WHEREAS, Grantor is the owner in fee of certain real property (the "Grantor Burdened Property") located in Anoka County, Minnesota, legally described as follows: The South Half of the Southwest Quarter of the Northwest Quarter, except the east 330 feet thereof, Section 24, Township 31 North, Range 22 West, Anoka County, Minnesota. WHEREAS, Sheehy is the owner in fee of certain real property (the "Sheehy Burdened Property") located in Anoka County, Minnesota, legally described as follows: The east 330 feet of the South Half of the Southwest Quarter of the Northwest Quarter, Section 24, Township 31 North, Range 22 West, Anoka County, Minnesota. WHEREAS, Grantor and Grantee desire to provide for an easement in perpetuity over a portion of the Grantor Burdened Property in favor of Grantee for the purpose of maintaining Anoka County Ditch 55 across the Grantor Burdened Property. WHEREAS, Grantor and Grantee desire to release and terminate all of the easement Grantee currently holds on the Grantor Burdened Property and Sheehy Burdened Property, except that easement conveyed by Grantor to Grantee in this document.
