<br />City of Centerville <br />COlUlell Meeting Minutes <br />October 26, 2005 <br /> <br />Mayor Capra made corrections to an article that was printed in the Quad Press regarding <br />this issue. <br /> <br />Mr. Larson reviewed the staff's changes to the document indicated he believes the <br />County will approve those changes. <br /> <br />Mr. Larson reviewed the revised concept plan for the Downtown Centerville project <br />noting the plan should be submitted to the County so they can incorporate it into their <br />plans for the CSAH 14 project. <br /> <br />The Council directed staff to discuss with the County the issue of the City conveying <br />property behind City Hall to the County, in return for the County convening property at <br />an equal marketable value within the City. <br /> <br />The Council directed that language be incorporated into the Memorandum of <br />Understanding and be emailed to all Council Member's. <br /> <br />Motion by Council Member Terway. seconded by Council Member Pur to aoDrove <br />the Memorandum of Undentandin2 for the CSAB 14 Widenio2 Proiect with the <br />noted chan2es. AD in favor. Motion carried uDanimooslv. <br /> <br />Mayor Capra called for a short recess at 1:55 p.m. <br /> <br />Mayor Capra reconvened the meeting at 8:00 p.m. <br /> <br />2. Possible Closed Meeting to Discuss Outstanding Litigation (R. Hugger Case) <br /> <br />Mr. Larson advised this case involves a forfeiture that did not go well. He stated he <br />spoke with the League of Minnesota Cities regarding this issue and they have indicated <br />there is coverage for this case. <br /> <br />Mr. Larson stated he does not believe there is anything else the City should do at this <br />point. Staff has spoke with a consultant who is willing to look at policies, at a reduced <br />cost, to make sure this situation does not occur again. A report and recommendations <br />will be submitted to the Council from that consultant. <br /> <br />Mr. Hoeft stated there is a new procedure already in place that will prevent this situation <br />from occurring again. He advised he does believe a consultant reviewing the policies <br />would be beneficial for the City. <br /> <br />Mayor Capra advised she believe the City should do its own investigation and report that <br />to the Police Department in December. The City would be proactive in doing its own <br />investigation and could prevent this situation from occurring at some point in the future. <br /> <br />Page 6 of8 <br /> <br />~. <br />
