<br />CITY OF CENTERVILLE <br />ANOKA COUNTY, MINNESOTA <br /> <br />ORDINANCE # <br />SECOND SERIES <br /> <br />AN ORDINANCE AMENDING CITY CODE, CHAPTER SECTIONS 51.05, 51.08, 51.09 AND <br />51.11 <br /> <br />THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS: <br /> <br />Section 1. Section 51.05 (A) ofthe Centerville City Code is hereby amended to read as follows: <br /> <br />(A) Billing, payment and delinquency. All municipal utilities shall be billed on a frequency as <br />prescribed by Council resolution and a utility statement or statements sent to each consumer. All <br />utilities charges shall be delinquent if they are unpaid within 30 days of the date of billing. Interest, <br />penalties and an administrative charge on delinquent accounts shall be established by Council <br />resolution as specified in the annual fee schedule. The city shall endeavor to collect delinquent <br />accounts promptly. Delinquent accounts may be submitted at any time for collection of the delinquent <br />amounts against the respective properties served. The roll shall be delivered periodically to the <br />Council for certification to the County Auditor for collection along with taxes. The action shall be <br />discretionary and may be in lieu of or in addition to any other action to collect delinquent accounts. <br /> <br />Section 2. Section 51.08 (B) ofthe Centerville City Code is hereby amended to read as follows: <br /> <br />(B) Not withstanding the other provisions of this chapter, property served by a private water or <br />private sewer system shall immediately connect to public sewer and public water whenever a private <br />sewer or private water system fails, falls into disrepair, or creates a nuisance or health hazard. A system <br />"falls into disrepair" when the cost of the repair exceeds $500.00. In any event, the necessity to bore a <br />new or replacement well is a condition which requires the property to connect to public water and <br />public sewer <br /> <br />Section 3. Section 51.09 (B) of the Centerville City Code is hereby amended to read as follows: <br /> <br />(B) Repair of leaks. It is the responsibility of the consumer or owner to maintain the service pipe <br />from and including the curb shut-off into the house or other building. In case of failure upon the part of <br />any consumer or owner to repair any leak occurring in his or her service pipe within 24 hours after oral <br />or written notice has been given the owner or occupant of the premises, the water may be shut off and <br />will not be turned on until a reconnection charge has been paid and the water service has been repaired. <br />When the waste of water is great or when damage is likely to result from the leak, the water will be <br />turned off if the repair is not proceeded with immediately. <br /> <br />I _ <br />
