<br />Exhibit A <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT ("Agreement") made effective this _ day of <br />, 2005 by and between ("Landowner") <br />and the CITY OF CENTERVILLE, a Minnesota municipal corporation ("City"). <br /> <br />RECITALS <br /> <br />WHEREAS, Landowner is the fee owner of real property situated in the City of <br />Centerville, Anoka County, Minnesota, legally described as <br />, according to the recorded <br /> <br />plat thereof (the "Subject Property"). <br /> <br />WHEREAS, Landowner wishes to construct a single-family residence on the <br />Subject Property. <br /> <br />WHEREAS, the City agrees to issue a building permit for the construction of a <br />new single-family residence on the Subject Property pursuant to the terms of this <br />Agreement. <br /> <br />NOW THEREFORE, in consideration of the mutual promises and covenants <br />herein contained and other good and valuable consideration, the receipt of which is <br />hereby acknowledged, the parties agree as follows: <br /> <br />1. Recitals. The foregoing recitals and prefatory paragraphs are hereby <br />incorporated into the body of this Agreement as if they were fully set forth herein. <br /> <br />2. Issuance of Building Permit. Landowner must file an application for a <br />building permit with the City, in compliance with all applicable building codes and <br />ordinances. Landowner must pay all fees and expenses associated with the issuance of a <br />building permit. The City will issue a building permit upon receipt of the completed <br />application and payment of all fees. <br /> <br />3. Installation of Temporary On-site Utilites. Because the Subject Property <br />is currently not served by the City's sanitary sewer or water systems, Landowner must <br />install Temporary On-site Utilities ("TOSU") to serve the property. The TOSU shall be <br />constructed entirely within Landowner's property and a permit shall be secured from the <br />City for such construction. <br /> <br />4. Connection with Public Water and Sanitary Sewer Systems. Landowner <br />agrees to connect to the City's public water and sanitary sewer systems in the normal <br />manner at the time that the Subject Property is served with watermain and/or sanitary <br />sewer main extensions, as provided by City Ordinance.
