<br />fi 157.02 STATUTORY AUTHORIZATION. <br /> <br />This chapter is adopted pursuant to M.S. ~~ 462.351, as amended, for cities and towns and 394.21, <br />as amended, for counties having a population ofless than 300,000 according to the 1950 federal census <br />(1990). <br />(Ord. 79, passed 3-9-2005) <br /> <br />fi 157.03 FINDINGS. <br /> <br />The city hereby finds that uncontrolled land-disturbing activity at construction sites is subject to <br />soil erosion and other pollutants which enter into receiving water bodies, adversely affecting the public <br />health, safety and general welfare by impacting water quality. <br />(Old. 79, passed 3-9-2005) <br /> <br />fi 157.04 PURPOSE. <br /> <br />The purpose of this chapter is to promote, preserve and enhance the natural resources within the <br />city and protect them from adverse effects occasioned by poorly sited development or incompatible <br />activities by regulating land-disturbing activities that would have an adverse and potentially <br />irreversible impact on water quality and environmentally sensitive land; by minimizing conflicts and <br />encouraging proper installation and maintenance of best management practices (BMPs) for land- <br />disturbing activities; and by requiring detailed review standards and procedures for land-disturbing <br />activities proposed for those areas, thereby achieving a balance between development, redevelopment <br />and protection of water quality and natural areas. <br />(Ord. 79, passed 3-9-2005) <br /> <br />fi 157.05 SCOPE AND EFFECT. <br /> <br />(A) Applicability. <br /> <br />(1) Every applicant of a building permit for a new building or addition, subdivision approval, <br />or a permit to allow land-disturbing activities greater than or equal to one acre, must submit a <br />stormwater pollution prevention plan to the City Administrator. No building permit, subdivision <br />approval or permit to allow land-disturbing activities shall be issued until approval of the stormwater <br />pollution prevention plan or a waiver of the approval requirement has been obtained in strict <br />conformance with the provisions of this chapter. <br /> <br />(2) The provisions of division (B) of this section apply to all land, public or private. <br /> <br />165 <br />
