<br />(2) It fronts on a public street; and <br /> <br />(3) The lot is within 70 percent of the minimum lot area and lot width required. <br /> <br />(C) If two or more lots are in single ownership and if all or part of the lots do not meet the width <br />and area requirements of this chapter, the contiguous lots shall be considered to be an undivided parcel <br />for the purpose of this chapter. <br />Cross-reference: <br />Lot provisions for subdivisions, see S 153.19 <br /> <br />~ 154..tLN:Q~~Q~~Q~!~~ Jl~l);~ A~Q ~r~ll~TIJ~S~ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ - { Deleted: 016 <br /> <br />Any structure or use existing upon the effective date of the adoption of this chapter which does not <br />conform to the provisions of this chapter may be continued, subject to the following conditions: <br /> <br />(A) The nonconforming use is not expanded or enlarged, except in conformity with the provisions <br />of this chapter; <br /> <br />(B) If a nonconforming use is discontinued or a nonconforming structure is abandoned for a <br />period of 12 months, further use of the structure or property must conform to this chapter; <br /> <br />(C) If a nonconforming use is replaced by another use, the new use shall conform to this chapter; <br /> <br />(D) If a nonconforming use or structure is damaged by any cause to the extent that repair or <br />replacement costs exceed 50 percent of the market value, the use or structure may not be replaced or <br />repaired except in conformity with this chapter; and <br /> <br />(E) Normal maintenance of a nonconforming structure is permitted, including necessary <br />nonstructural repairs and incidental alterations, which do not extend or intensify the nonconforming <br />use. <br /> <br />(F) A structure that consists of a one-family or two-family dwelling that is a lawful non- <br />conforming use located in a Business District or Industrial District may, upon being damaged to an <br />extent exceeding 50 percent of its fair market value, be repaired to its preexisting condition, provided <br />that the non-conformity does not also include inconsistencies with regulations of flood-plaints or <br />shore land protection. If no building permit to repair the dwelling is issued by the City within six <br />months of the date of the event where damage occurs, then the lawful non-conforming use status shall <br />cease and the land shall be used only in conformity with the allowed uses in the District. <br />(Ord. 2d #6, amended 5/24/06) <br /> <br />(G) Construction of one detached accessory building, not exceeding 200 square feet will be <br />considered an incidental alteration, and may be permitted in conjunction with a legal, non-conforming <br /> <br />92 <br />
