Comment Letter prepared by MN DNR, dated August 30, 2004, <br />received September 1, 2004. <br /> <br />15. RCWD Permit File 98-088. <br /> <br />Findings: <br /> <br />1. The project entails a lot split on Lot 4, Block 2 (1.9:f: acres) of The <br />Woods of Clearwater Creek approved under RCWD Permit 98-088. <br /> <br />2; Runoff from the proposed home would flow over green Space before <br />discharging to DNR Public Waters Wetland 545w (DNR 545w). <br />Driveway runoff will drain to both DNR 545w and Brian Drive, 0 <br />which drains to a stoImwater pond constructed as part of RCWD <br />Permit 98-088. This satisfies District stormwater management <br />requirements. <br /> <br />3. District staff has field verified 0 existing wetland boundaries as <br />consistent with the delineation approved under RCWD Permit 98- <br />088. This project proposes filling 1,744 SF (0.04 acres) of Type 6/7 <br />wetland within DNR 545w. ThIS exceeds the deminimis exemption <br />of 400 SF; therefore, 2: 1 replacement is required per WCA rules. <br /> <br />A wetland replacement plan appljc~tlon and -sequencin~ narrative <br />have been submitted, which indicates the Applicant intends oOn <br />purchasing wetland bank credits to provide the required mitigation. <br />However, j\lstification for purchasing replacement credits in an <br />adjacent watershed is required. Additionally, the proposed <br />replacement wetland. to be purchased is "out-of-lOnd" because it is <br />not the same wetland type as the impacted wetland (Type 2). <br />Therefore, the required replacement ratio is 2.25:1. These comme~ts <br />must be addressed before proposed wetland banking credits may be <br />approved to mitigate for the proposed impacts. Proof of purchase of <br />this wetland bank credit is required (after TEP acceptance of <br />sequenc'ing). 0 <br /> <br />4. There is no RCWD 100-year regulatory flood elevation established <br />for this site. No floodplain fill is proposed. <br /> <br />The proposed driveway will cross the overland outlet route of the <br />onsite w~tland (DNR 545w)? which is to be mainta.ined by a culvert _ <br />o of unspecified size. The proposed culvert invert elevations are <br />. . 904.5(5) and 904.2(N), respectively.
