<br />recommendations concerning the proposed interim use. Such report shall be <br />accompanied by fmdings of fact specifying the reasons for the recommendation. In <br />considering interim use applications in the Flood Plain Districts, the Planning <br />Commission shall consider all requirements of this Chapter together with Chapter 155, <br />Flood Damage Prevention. <br /> <br />(4) The Council shall. within 30 days of the receipt of the report of the Planning <br />Commission, grant or deny the interim use or refer the matter back to the Planning <br />Commission for further consideration. The Council shall not grant a interim use unless it <br />fmds that the standards of this Section have been satisfied. Any proposed interim use <br />which fails to receive the approval of the majority of the members of the Planning <br />Commission voting upon it shall not be approved except by a favorable vote of four-fifths <br />of all of the elected members of the Council. <br /> <br />(5) An Interim Use Permit shall be valid for a period of one year from the date <br />of its approval by the Council, after which the same shall be revoked in the event that any <br />proposed construction, alteration or operation has not been started in accordance with the <br />terms of such permit. <br /> <br />(6) The interim use must comply with the specific standards for the use <br />identified in this chapter and must comply with all conditions of approval, which shall be <br />included in an Interim Use Permit agreement. <br /> <br />(0) Termination. All Interim Use Permits shall terminate on the happening of any of <br />the following events, whichever frrst occurs: <br /> <br />(1) The date stated on the permit; <br /> <br />(2) Upon violation of the condition under which the permit was issued; or <br /> <br />(3) Upon change in the city's zoning regulations that renders the use <br />nonconforming. <br /> <br />(E) Right of Enforcement. All Interim Use Permits are immediately void when a <br />condition is no longer observed or a condition has expired. The Permit may only be <br />renewed after a new application for an Interim Use Permit has been granted as set forth in <br />this section. The Permit shall not run with the land. Failure of the City to discover the <br />violation of a condition, or failure by the City to act upon a violation of a condition does <br />not constitute a renewal of the Interim Use Permit or a waiver of the City's right to take <br />enforcement action. <br /> <br />~~ 156.351 THROUGH 156.399 RESERVED FOR FUTURE EXPANSION. <br />i 156.400 ENFORCEMENT AND VIOLATIONS. <br /> <br />The Zoning Administrator is directed by the City Council to enforce the provisions <br /> <br />70 <br />
