<br />A) There is a reasonable public notice and the goods are sold through public <br />auction; and <br /> <br />B) The property is sold by a sealed bid process and the Employee has the <br />highest responsible bid. The Employee who buys the property must not be <br />involved in the auction or sealed bid process. <br /> <br />- - - <br />No Employee may accept any gift or gratuity in any size under circumstances in <br />which it could be reasonably thought to influence him or her in the performance of <br />his or her official duties or in which it appears to be a reward for any official action <br />on his or her part. Gifts or gratuities which may be acceptable are as follows: <br /> <br />A) A wards for meritorious civic service contribution; <br /> <br />B) Unsolicited items that are donated to and shared by the work group; <br /> <br />C) Unsolicited advertising or promotional materials with a value of less than <br />$5.00; <br /> <br />D) Unsolicited items such as meals which may be provided during meetings, <br />receptions, or other gatherings where the elected official or Employee is in <br />attendance in his/her official capacity. <br /> <br />20.3 Nepotism <br /> <br />General: Relatives of current City Employees and City Council members are not <br />eligible for employment in job classification in which a conflict of interest may occur. <br />Therefore, relatives will not be hired where: <br /> <br />A) One relative would have the sole authority or practical power to supervise, <br />appoint, remove, or discipline the other; <br /> <br />B) One relative would be responsible for auditing the work of the other; <br /> <br />C) Other circumstances exist which would place the relative in a situation of <br />actual or reasonable foreseeable conflict between the City's interests or their <br />own; or <br /> <br />D) Where the applicant/City Employee has a relative who is employed by an <br />organization with whom the City has business dealings, and in the City's <br />judgment, considering the positions and job responsibilities of both the <br />applicant/Employee and the relative would create an appearance of improper <br />influence or favor or would jeopardize the confidentiality of data maintained <br />by the City. <br /> <br />The City is not obligated to give special treatment, such as preferential scheduling, to <br />married couples. <br /> <br />Definitions: <br /> <br />Page 35 of 46 <br />Adopted 11-09-2005 <br />
