<br />RESOLUTION <br />RESOLUTION ORDERING THE IMPROVEMENT OF THE PROPOSED <br />ACORN CREEK DEVELOPMENT <br /> <br />WHEREAS, the Centerville City Council met on September 23, 1992 <br />to discuss the extension of municipal sewer and water <br />through the proposed Acorn Creek development; and <br /> <br />WHEREAS, Gerald Rehbein, Vice President of R & R Leasing and <br />developer of the proposed Acorn Creek development has <br />verbally requested City Installed Improvements on said <br />development; and <br /> <br />WHEREAS, Gerald Rehbein has advised that he will waive his right <br />to appeal; and <br /> <br />WHEREAS, Gerald Rehbein has advised that he will waive his right <br />to an improvement hearing; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />CENTERVILLE, MINNESOTA: <br />Such City Installed Improvement is hereby ordered as <br />verbally requested by Gerald Rehbein, Developer; <br /> <br />LET IT FURTHER BE RESOLVED THAT said improvement shall be <br />constructed by Ro-So Contracting, Inc. by change order to <br />the Center Hills, Third Addition and Municipal Water <br />Extension contract bid for a dollar amount not to exceed 25% <br />of the original bid portion of the Center Hills, Third <br />Addition which is $58,317.23. <br /> <br />CONTINGENT UPON: <br />- receipt of a signed petition from the developer/owner for <br />the improvement of municipal sewer and water extension <br />through the proposed Acorn Creek development; <br />receipt of dedicated sewer and water easements across said <br />property; <br />receipt of verification of clear title to the developer; <br />legal permission by the property owner to access the <br />property to install municipal sewer and water lines <br />through the proposed Acorn Creek development, to <br />include a hold harmless clause releasing the City of <br />any and all liability for the construction period, to <br />continue perpetually into the future for maintenance <br />purposes; <br />receipt of copies of permit approvals from Rice Creek <br />Watershed District, Minnesota Pollution Control Agency, <br />Minnesota Department of Health and/or other appropriate <br />agencies. <br />
