RESOLUTION RESOLUTION ORDERING THE IMPROVEMENT OF THE PROPOSED ACORN CREEK DEVELOPMENT WHEREAS, the Centerville City Council met on September 23, 1992 to discuss the extension of municipal sewer and water through the proposed Acorn Creek development; and WHEREAS, Gerald Rehbein, Vice President of R & R Leasing and developer of the proposed Acorn Creek development has verbally requested City Installed Improvements on said development; and WHEREAS, Gerald Rehbein has advised that he will waive his right to appeal; and WHEREAS, Gerald Rehbein has advised that he will waive his right to an improvement hearing; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA: Such City Installed Improvement is hereby ordered as verbally requested by Gerald Rehbein, Developer; LET IT FURTHER BE RESOLVED THAT said improvement shall be constructed by Ro-So Contracting, Inc. by change order to the Center Hills, Third Addition and Municipal Water Extension contract bid for a dollar amount not to exceed 25% of the original bid portion of the Center Hills, Third Addition which is $58,317.23. CONTINGENT UPON: - receipt of a signed petition from the developer/owner for the improvement of municipal sewer and water extension through the proposed Acorn Creek development; receipt of dedicated sewer and water easements across said property; receipt of verification of clear title to the developer; legal permission by the property owner to access the property to install municipal sewer and water lines through the proposed Acorn Creek development, to include a hold harmless clause releasing the City of any and all liability for the construction period, to continue perpetually into the future for maintenance purposes; receipt of copies of permit approvals from Rice Creek Watershed District, Minnesota Pollution Control Agency, Minnesota Department of Health and/or other appropriate agencies.
