Pursuant to due call and notice thereof, the City Council of the City of Centerville held an "emergency" meeting on Thursday, July 31, 1992 at City Hall. Mayor Buckbee called the meeting to order at 7:35 a.m. Present: Wilharber, Burgstahler. The "emergency" was called because of the following circumstances that, in the judgement of the Council, required immediate Council consideration. Guaranteed Maximum Price of the Municipal Facility In order for the City to advertise for bids and schedule construction so that a completion date of December 31, 1992 could be accomplished for the municipal facility it was necessary for the City Council to meet prior to Friday, July 31, 1992, 3:00 p.m. The City Council considered a revised proposal for a Guaranteed Maximum Price of the Municipal Facility dated July 28, 1992 from Gilbert Construction Co., Inc. A copy of that letter is on file with the Clerk/Administrator. Motion by Buckbee, second by Wilharber to approve and authorize: the Guaranteed maximum price for the Municipal Facility, based upon the July 28, 1992 letter from Gilbert construction; - the signing of the Gilbert Construction Co., Inc. and City of Centerville agreement/contract with a Guaranteed Maximum Price of $556,631.00; - the advertisement for bids for the Municipal Facility, based upon the July 28, 1992 letter from Gilbert Construction Co., Inc.; motion carried unanimously. Aporoval of Disbursement of $3,000 Surety (Refundable) to Rice Creek Watershed District for Municipal Facilitv In order for the City to schedule construction so that a completion date of December 31, 1992 could be accomplished for the municipal facility it was necessary to secure the Rice Creek Watershed District permit. A surety in the amount of $3,000 is need to finalize the permit process. The contractor requested the check by Monday, August 3, 1992 in order to keep on schedule. Motion by Burgstahler, second by Wilharber to approve disbursement of a $3,000 surety check to the Rice Creek Watershed District to secure the necessary permit for the Municipal Facility; it is understood that this surety is refundable after completion of the project, if all Rice Creek Watershed requirements have been met, motion carried unanimously. Center Hills, Third Addition - Consideration of Shared Costs of Improvement As per the July 22, 1992 City Council meeting, Mayor Buckbee and Council member Pelton met with Gerald Rehbein, Developer of the Center Hills, Third Addition to discuss Mr. Rehbein.s request for
