<br />ORDINANCE NO. 36 <br />CITY OF CENTERVILLE <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE REGULATING OPEN BURNING WITHIN THE CITY OF <br />CENTERVILLE, ANOKA COUNTY, MINNESOTA, AND PROVIDING <br />PENALTIES FOR THE VIOLATION THEREOF. <br /> <br />The City Council of the City of Centerville, Anoka County, <br />Minnesota, does hereby ordain: <br /> <br />SECTION 1. DEFINITIONS <br />a. PERSON. Shall be as defined in Minnesota <br />Statutes Section 116.06, Subd. 8. <br /> <br />b. OPEN BURNING. Burning any matter whereby the <br />resultant combustion products are emitted <br />directly to the open atmosphere without <br />passing through any adequate control equipment. <br /> <br />c. CONTROL EQUIPMENT. Control equipment shall <br />mean any device, approved by the Minnesota <br />Pollution Control Agency, which has the <br />function of controlling or abating the emission <br />of air contaminants to the atmosphere. <br /> <br />d. RECREATIONAL FIRES. Wood burning fireplaces <br />and open fires used solely for outdoor food <br />preparation. <br /> <br />e. BURNING PERMIT. A written permit issued by <br />the City Fire Chief authorizing fires exempted <br />from the general provisions hereof, and <br />setting conditions therefor. <br /> <br />SECTION 2. OPEN BURNING PROHIBITED <br /> <br />From and after the effective date of this Ordinance, <br />except as herein otherwise provided, open burning shall be <br />prohibited within the City of Centerville. <br /> <br />SECTION 3. EXEMPTIONS <br /> <br />Open burning of the types, and subject to the conditions, <br />as hereinafter stated, shall be exempt from the prohibition <br />of Section 2 of this Ordinance: <br /> <br />a. Recreational fires. <br /> <br />b. Fires under managed supervision, for which a <br />written burning permit has first been obtained <br />from the City Fire Chief, where necessary, but <br />limited to the following: <br /> <br />1) Fires purposely set for the instruction and <br />training of public and industrial firefighting <br />personnel. <br />
