<br /> <br />tervi{{e <br /> <br />'E.,ta.6(ish cd 1.',_57 <br /> <br />1880 ;Main Street, Centervfffe, :M.:N 55038 <br />fS1429-3232 or 'FiL'(651-429 8629 <br /> <br />CITY OF CENTERVILLE <br /> <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br /> <br />RESOLUTION #09-J"-' <br /> <br />RESOLUTION AUTHORIZING CONDEMNATION OF PRIVATE <br />PROPERTY FOR PUBbIC W ALKW AY & TRAIL EASEMENTS <br /> <br />WHEREAS, the City Council of the City of Centerville does hereby determine <br /> <br />that it is necessary and for a public use and purpose to acquire easements over the <br /> <br />property described on the attached Exhibit "A" ("Property") for public walkway and trail <br /> <br />easements and temporary construction purposes in connection with 2009 Trail <br /> <br />(Transportation Enhancement) Improvements; and <br /> <br />WHEREAS, City staff and consultants have made or will make offers to acquire <br /> <br />the public utility and drainage easements over and under the Property from the owners of <br /> <br />the Property; and <br /> <br />WHEREAS, the City Council finds that the need for the Project and construction <br /> <br />conditions related to the Project make it necessary to acquire the easements to, and <br /> <br />possession of, the Property as soon as possible in order for the Project to proceed in an <br /> <br />efficient, cost effective and expeditious manner. <br /> <br />NOW, THEREFORE, be it resolved by the City Council of the City of <br /> <br />Centerville, Minnesota: <br /> <br />1. That the City Attorney is authorized to commence eminent domain <br /> <br />proceedings pursuant to Minnesota Statute Chapter 117 to acquire the real property <br />
