<br />Planning & Zoning Commission Report and Recommendation. <br /> <br />The Planning & Zoning Commission met on April 7, 2009, to hold a public hearing to <br />consider a request of Will Lessard and Lake Area Contracting to plat their property. <br /> <br />Findings: <br /> <br />1) The property is currently Outlot A within an earlier plat of Center Villa and is zoned <br />B-1, Commercial. <br />2) The Commission finds that there would be benefit to both the City and the applicant <br />property owners by platting the property. <br />3) The applicant provided evidence to show that the two new lots created by the plat will <br />meet the minimum lot size and dimensions of the zoning ordinance. <br />4) The applicant provided evidence that the buildings that are on the property will have <br />at least the minimum setbacks from the newly created property lines. <br />5) State Law allows Anoka County the opportunity to require right of way dedication by <br />virtue of the fact that the property abuts Anoka County Road CSAH 54. <br />6) Applicant property owner previously failed to record a trail easement over the <br />property. <br /> <br />RECOMMENDATION: <br /> <br />The Planning & Zoning Commission recommends that the Council grant preliminary and <br />final plat approval, subject to the following: <br /> <br />1) Owner shall execute and record the prior trail easement before the City <br />Council gives final approval to the plat. <br />2) Anoka County right of way requirements shall be incorporated into the plat. <br /> <br />Dallas Larson, Administrator <br /> <br />38 <br />
