<br />JOINT POWERS AGREEMENT <br />LAKE PEL TIER <br />WATER SURFACE USE <br /> <br />I. PARTIES. This Agreement is made and entered into by and between the CITY OF <br />LINO LAKES, a municipal corporation and political subdivision of the State of Minnesota, <br />(herein "Lino Lakes), and the CITY OF CENTERVILLE, a municipal corporation and political <br />subdivision ofthe State of Minnesota (herein "Centerville"). <br /> <br />II. RECITALS. Lake Peltier is located within the corporation boundaries ofLino Lakes <br />and Centerville and has a public access for boats. The waters of Lake Peltier are used <br />extensively by the public for boating, fishing and other recreational purposes. Lake Peltier <br />Island contains a unique Great Blue Heron and White Egret nesting colony. <br /> <br />Regulation of boating traffic on Lake Peltier is necessary in order to minimize adverse impact on <br />natural resources and to protect the health, safety and welfare of the residents ofLino Lakes and <br />Centerville who reside on properties surrounding Lake Peltier and of those people who use Lake <br />Peltier for recreational purposes. By means of this Joint Powers Agreement adopted pursuant to <br />Minn. Stat. ~~ 459.20 and 471.59, Lino Lakes and Centerville will establish guidelines <br />applicable to the adoption of ordinances by each City restricting the speed and use of motorized <br />watercraft on Lake Peltier. <br /> <br />III. TERMS AND CONDITIONS. In Consideration of the mutual undertakings herein <br />expressed, Lino Lakes and Centerville agree as follows: <br /> <br />A. Each City shall adopt an ordinance which incorporates the following guidelines: <br /> <br />1. Adopts the definitions ofMinn. Stat. ~86B.005. <br /> <br />2. A slow no-wake speed 24 hours per day all year in the area to the North of the <br />Southern section lines of Sections 10 and 11 of Township 31 N Range 22W <br />starting at the southern boundary ofRehbeins Peltier View Subdivision ofLino <br />Lakes will be enforced. <br /> <br />Exemptions: <br /> <br />i. Authorized resource management emergency and enforcement <br />personnel, when acting in the performance of their duties, shall be <br />exempt from the provisions of this ordinance. <br /> <br />ii. A temporary exemption from these restrictions for a special event <br />may be granted upon approval by the City Council and the <br />issuance of a permit by the Anoka County Sheriff's Department. <br />
