<br />on the licensed premises to touch, caress or fondle the <br />covered or uncovered breasts, buttocks, anus or genitals <br />of any other person; or <br /> <br />(f) while such employee or person encourages or permits <br />any of the behavior, conditions or acts hereinabove set <br />forth by any other person pr persons. <br /> <br />Whenever the term ~person" is used in this subdivision, it <br />shall include but not be limited to, any licensee, host, <br />hostess, other employer or employee, independent <br />contractor, customer, spectator or any other person. All <br />provisions of this subdivision shall apply equally to both <br />sexes. <br /> <br />405.09 Suspension and Revocation. The Council may either <br />suspend for not to exceed 60 days or revoke any non- <br />intoxicating liquor license, or impose a civil fine not to <br />exceed $2,000 for each violation, upon a finding that the <br />licensee has failed to comply with any applicable statute, <br />regulation, or section relating to non-intoxicating liquor. <br /> <br />405.10 No Suspension or Revocation Shall Take Effect Until <br />License Has Been Afforded An Opportunity for a Hearing. No <br />suspension or revocation shall take effect until <br />the licensee has been afforded an opportunity for a hearing <br />before the Council pursuant to sections 14.57 through 14.69 <br />of the State's administrative procedure act. <br /> <br />SECTION 406 LICENSING AND REGULATING <br />THE SALE AND CONSUMPTION OF WINE <br /> <br />406.01 Provisions of State Law Adopted. Except where this <br />Section contains a more restrictive provision, the <br />provisions of Minn. Stat., Chap. 340A, relating to the <br />definition of terms, licensing, consumption, sales, hours <br />of sale, and all other matters pertaining to the retail <br />sale, distribution, and consumption of wine are adopted and <br />made a part of this Section as if set out in full. <br /> <br />406.02 License Required. <br /> <br />Subd. 1 Licenses. No person, except wholesalers or <br />manufacturers to the extent authorized by law, shall deal <br />in or dispose of by gift, sale or otherwise, or keep or <br /> <br />.'i, <br /> <br />Chapter 4 <br /> <br />. <br /> <br />20 <br /> <br />"'. <br />
