<br />406.09 On-sale of Intoxicating Malt Liquor. <br /> <br />Subd. 1 Sale Permitted. The holder of an on-sale <br />wine license pursuant to this Section 406, which also holds <br />an on-sale non-intoxicating malt liquor ordinance pursuant <br />to Section 405, may sell intoxicating malt liquor at on- <br />sale without an additional lic;ense if the licensee meets <br />the requirements of Subd. 2. <br /> <br />Subd. 2 Affidavit Required. The licensee's gross <br />receipts from the licensed premises must be at least 60 <br />percent attributable to the sale of food. This requirement <br />shall be established by an affidavit of the licensee, on a <br />form provided by the City, given with each application for <br />issuance or renewal of an on-sale wine license. In <br />addition, the licensee shall give such an affidavit at such <br />other times as the City may request. Also, the City, at <br />any time and from time to time, may require that any such <br />affidavit be verified and confirmed, on a form provided by <br />the City, by a certified public accountant. Failure or <br />refusal of a licensee to give such an affidavit, or any <br />false statement in any such affidavit, shall be grounds for <br />denial, suspension or revocation of all licenses- held by <br />such licensee for the on-sale of non-intoxicating malt <br />liquor or the on-sale of wine. <br /> <br />406.10 Suspension and Revocation. The Council may either <br />suspend for not to exceed 60 days or revoke any wine <br />license, or impose a civil fine not to exceed $2,000 for <br />each violation, upon a finding that the licensee has failed <br />to comply with any applicable statute, regulation, or <br />ordinance relating to wine or non-intoxicating malt liquor. <br />No suspension or revocation shall take effect until the <br />licensee has been afforded an opportunity for a hearing <br />before the Council pursuant to Sections 14.57 through 14.69 <br />of the State's Administrative Procedure Act. <br /> <br />SECTION 410 - REGULATING AND CONTROLLING LICENSING <br />OF PRIVATE CLUBS <br /> <br />410.01 Definitions.
