Adopting the Minnesota Building Code <br /> <br />5 Amenued: <br />4 Amended: 2/19102 <br />3 Amended: 9/4/0 I <br />'1 Amended: 6/27/01 <br />I Amended; 1110/0 I <br />Effective 9/5/00 <br />City ofCcmervil]e Oni. #4 <br /> <br />Providing for its administration and enforcement, regulating the erection, <br />construction, occupancy, equipment, use, height, area and maintenance of all <br />buildings and/or structure in the City of Centerville; providing penalties for the <br />violation thereof. <br /> <br />Division 25: Lot Provisions <br /> <br />Lots of Record <br /> <br />A No lot of record shall be reduced in size below the district requirements in <br />Section 080-030; and <br /> <br />B. An existing lot of record shall be deemed a buildable lot even though the lot area <br />and/or dimensions are less than those required for the district provided as follows: <br /> <br />1. Evidence must be presented that the lot in question met <br />minimum requirements for the division of property under <br />ordinance regulations in effect at the time of the division of <br />property; and <br /> <br />2. It fronts on a public street; and <br /> <br />3. The lot is within seventy percent (70%) of the minimum tot area <br />and tot width required. <br /> <br />C. If two (2) or more lots are in single ownership and if all or part of the lots do not meet <br />the width and area requirements of this Ordinance, the contiguous lots shall be <br />considered to be an undivided parcel for the purpose of this Ordinance. <br /> <br />Division 30: Non-ConforminQ Uses and Structures <br /> <br />Any structure or use existing upon the effective date of the adoption of this Ordinance, which does not <br />conform to the provisions of the Ordinance, may be continued subject to the following conditions: <br /> <br />A The non-conforming use is not expanded or enlarged, excei_. in conformity with the <br />provisions of this Ordinance; and <br /> <br />- <br /> <br />B. If a non-conforming use is discontinued or a non-conforming structure is abandoned <br />~ for a period of siJ: (C) twelve (12\5 months, further use of the structure or property <br />~ <J must conform to this Ordinance; and - <br /> <br />rfJ Page 16 of69 <br />
