5 Amended: 4 Amended: 2/19/02 3 Amended: 9/4101 2 Amended: 81710 I 1 Amended: 1/30/01 Effective 9/5/00 City ofCenterville Ord. #4 Usable Open Space - A ground area on a lot, which is graded, developed, landscaped or equipped or intended and maintained for recreation or leisure, available to and useable by persons occupying a dwelling unit and their guests. Variance - The waiving by Board action of the literal provisions of the Zoning Ordinance in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consicjeration. Vehicle - Any vehicle which is self-propelled or designed to be pushed or pulled and shall include, but not be limited to, automobile, busses, motorbikes, motorcycles, motor scooters, trucks, tractors, go-carts, golf carts, campers, trailers, boats, planes and gliders. Vehicle Abandoned - Any vehicle as defined in this section, which does not have lawfully affixed or attached thereto an un-expired state registration or license plate or plates, or the condition of which is wrecked, dismantled, partially dismantled, inoperative, abandoned or discarded. Water-Oriented Accessory Structure or Facility - A small above ground building or other improvement ,xcept stairways, fences, docks, and retaining walls, which, because of the relationship of its use to a surface water feature, reasonably needs to be located closer to public waters than the normal structure setback. Examples of such structures and facilities include boathouses, gazebos, screen houses, fish houses, pump houses, and detached decks. Wetland - Lands transitional between terrestrial and aquatic systems where the water table is usually at or near the surface or the land or is covered by shallow water. For purposes of this definition, wetlands must have the following three characteristics: A. Predominance of hydric soils; and B. Are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support a prevalence of hydrophytic vegetation typically adapted for life in saturated soil conditions; and C. Under normal circumstances support a prevalence of such vegetation. Yard. A required open space on a lot which is unoccupied and unobstructed from the ground upward, except as otherwise provided for herein. The measurement of a yard shall be construed as the minimum horizontal distance between the lot line and the building line.
