<br />5 Amended: <br />4 Amended: 2/19/02 <br />3 Amended: 9/4101 <br />2 Amended: 81710 I <br />1 Amended: 1/30/01 <br />Effective 9/5/00 <br />City ofCenterville Ord. #4 <br /> <br />Usable Open Space - A ground area on a lot, which is graded, developed, landscaped or equipped or <br />intended and maintained for recreation or leisure, available to and useable by persons occupying a <br />dwelling unit and their guests. <br /> <br />Variance - The waiving by Board action of the literal provisions of the Zoning Ordinance in instances <br />where their strict enforcement would cause undue hardship because of circumstances unique to the <br />individual property under consicjeration. <br /> <br />Vehicle - Any vehicle which is self-propelled or designed to be pushed or pulled and shall include, but not <br />be limited to, automobile, busses, motorbikes, motorcycles, motor scooters, trucks, tractors, go-carts, golf <br />carts, campers, trailers, boats, planes and gliders. <br /> <br />Vehicle Abandoned - Any vehicle as defined in this section, which does not have lawfully affixed or <br />attached thereto an un-expired state registration or license plate or plates, or the condition of which is <br />wrecked, dismantled, partially dismantled, inoperative, abandoned or discarded. <br /> <br />Water-Oriented Accessory Structure or Facility - A small above ground building or other improvement <br />,xcept stairways, fences, docks, and retaining walls, which, because of the relationship of its use to a <br />surface water feature, reasonably needs to be located closer to public waters than the normal structure <br />setback. Examples of such structures and facilities include boathouses, gazebos, screen houses, fish <br />houses, pump houses, and detached decks. <br /> <br />Wetland - Lands transitional between terrestrial and aquatic systems where the water table is usually at <br />or near the surface or the land or is covered by shallow water. For purposes of this definition, wetlands <br />must have the following three characteristics: <br /> <br />A. Predominance of hydric soils; and <br /> <br />B. Are inundated or saturated by surface or groundwater at a frequency and duration <br />sufficient to support a prevalence of hydrophytic vegetation typically adapted for life <br />in saturated soil conditions; and <br /> <br />C. Under normal circumstances support a prevalence of such vegetation. <br /> <br />Yard. A required open space on a lot which is unoccupied and unobstructed from the ground upward, <br />except as otherwise provided for herein.
