<br />~ <br /> <br />. <br /> <br />City ofCenterville <br />Council Meetings <br />March 27, 2002 <br /> <br />the City has had its hands tied by Lino Lakes concerning the sunset clause because, if the. <br />City wants the Ordinance to be enforceable, then it must adopt the same language. <br /> <br />Mayor Swedberg commented that, if the ordinance does not appear to be working as <br />written, there is always the option of amending the ordinance. He then said he did not <br />think the City would be looking at heavy enforcement of the ordinance because it is <br />simply a matter of manners. <br /> <br />Council Member Capra asked City Attorney Hoeft what would happen with the Lino <br />Lakes ordinance if Centerville voted to table. <br /> <br />City Attorney Hoeft indicated that the ordinance would go into effect but Lino Lakes has <br />the ability to amend it at any time. <br /> <br />Vote: All in favor. Motion carried unanimously. <br /> <br />Motion bv Council Member Capra. seconded bv Council Member Nelson to direct <br />staff to invite Lino Lakes to a ioint work session to discuss Ordinance #68 and other <br />related joint issues. Motion <br />carried. <br /> <br />Motion bv Council Member Broussard Vickers. seconded bv Council Member <br />Nelson to approve the Joint Powers Allreement with Lino Lakes as presented. <br /> <br />Council Member Capra asked if the Joint Powers Agreement could be amended. City <br />Attorney Hoeft indicated that it could be. . <br /> <br />Vote: All in favor. Motion carried unanimouslv. <br /> <br />Council recessed at 8:35 p.m. <br /> <br />Council Member Capra thanked all those that gave testimony on the issue. <br /> <br />Council reconvened at 8:45 p.m. <br /> <br />2. Pheasant Marsh Final Plat/Developers Agreement <br /> <br />Mr. Dale Runkle of Ground Development addressed Council and asked that Council <br />follow the Ordinance and allow Ground Development to post a surety bond for private <br />improvements rather than the letter of credit. He then indicated that the letter of credit <br />affects the company's ability to borrow funds for other projects and the surety bond <br />would provide the security needed by the City to ensure that the company will do what it <br />says it will do. <br /> <br />Page 10 of 18 <br />
