<br />5 Amended: <br />4 Amended: 2/19/02 <br />3 Amended: 9/4/0 1 <br />2 Amended: HnJO 1 <br />I Amended: 1/30/01 <br />Effective 9/5/00 <br />City ofCenterville Ord. #4 <br />proceedings in furtherance of the action appealed from unless the Zoning <br />Administrator certifies to the Council that by reason of facts stated in the certificate <br />a stay would, in his opinion, cause imminent peril to life or property. In that case <br />the proceedings shall not be stayed otherwise than by a restraining order granted <br />by a court of competent jurisdiction. The Council shall at its next regular meeting <br />after the filing of an Appeal to it from a decision of the board set a date for hearing <br />thereon, which shall be not late than sixty (50) days after the meeting. After hearing <br />the oral or written views of all interested persons, the Council shall make its <br />decision at the same meeting or at a specified future meeting thereof. The decision <br />of the Council may be appealed to the County District Court. <br /> <br />Division 190: Interim Uses <br /> <br />Section 190-010: Purpose. In addition to the purposes stated in Section 2 of this Ordinance, it is <br />intended that the Interim Use Permit procedures allow flexibility in the use of land or structures in the <br />City, when such uses are not permanent and when such uses meet appropriate conditions and <br />performance standards that protect the public health, safety and welfare. <br /> <br />Section 190-020: Application, Public Hearing, and Procedure. The application, pUblic hearing, <br />notice and procedure requirements for Interim Use Permits shall be the same as those for Amendments, <br />as provided in ~e6tieR 1.Q:i Division #1955 ofthis Ordinance. If a proposed interim use is not listed as a <br />permitted interim use in this Ordinance, a text amendment to this Ordinance will be required before an <br />Interim Use Permit may be considered. <br /> <br />Section 190-030: Termination. All Interim Use Permits shall terminate on the happening of any ofthe <br />following events, whichever first occurs: <br /> <br />A. The date stated on the permit. <br /> <br />B. Upon violation of the condition under which the permit was issued. <br /> <br />C. Upon change in the City's zoning regulations that renders the use non- <br />conforming. <br /> <br />Section 190-040: Standards. The Interim Use must be allowed in the Zoning District where the <br />property is located. The Interim Use must meet or exceed the performance standards set forth in this <br />Ordinance and other applicable City Ordinances. The interim use must comply with the specific <br />standards for the use identified in this Ordinance, and must comply with all conditions of approval, which <br />shall be included in an interim use permit agreement. <br /> <br />Section 190-050: Conditions. The City may attach conditions to approval of a permit to mitigate <br />anticipated adverse impacts associated with the use, to ensure compliance with the standards of <br /> <br />~- ~-.p~Or:=;~-:-..;..?i':;- 11. <br />
