<br />, <br /> <br />City of Centerville <br />Council Meeting Minutes <br />May 22, 2002 <br /> <br />Council Member Broussard Vickers asked if there was a survey done when the land was <br />purchased. Mr. Black indicated a survey was done on the piece being purchased but that <br />would not have indicated this type of issue with the adjoining parcel. <br /> <br />Council Member Broussard Vickers asked if the survey showed road frontage. Mr. Black <br />indicated it did not. <br /> <br />Mr. Black indicated the area in question was 30 feet by 60 feet in a triangular shape. <br /> <br />Mayor Swedberg counnented that 40 of the 60 fuet is in the easement area. <br /> <br />Mr. Black indicated the Metropolitan Waste Counnission expanded its easement for a <br />sewer line but that easement was acquired for their purposes not for a roadway. He then <br />said the small triangular piece is encumbered with an easement already. <br /> <br />Council Member Capra asked if there was any other property that involved Mr. <br />Carpenter. Mr. Black said no. <br /> <br />Council Member Capra indicated that Mr. Eibensteiner bas made offers and counteroffers <br />but the two parties are miles apart. ........ Mr. Black indicated that they did not know until Mr. <br />Carpenter informed them. <br /> <br />Mayor Swedberg asked whether right-of-way is automatically dedicated when a plat is <br />finalized that contains a street or whether the City has to purchase the right-of-way land. <br /> <br />City Attorney Hoeft indicated that the plat in question does not contain that sliver of <br />property. <br /> <br />Council Member Nelson asked whether the street could be moved. <br /> <br />Council Member Travis indicated that moving the road would cost the City $80,000 and <br />there would also be a cost to the developer. <br /> <br />Mr. Rehbein indicated that the City spent $76,000 to put in the lift station on that <br />property. <br /> <br />Council Member Capra asked if a surveyor had clarified that this property does belong to <br />Mr. Carpenter. <br /> <br />Mr. Black indicated his property had been surveyed and does not go all the way to the <br />road. <br /> <br />Mr. Rehbein clarified that the County easement stops at the ditch and Mr. Carpenter owns <br />the sliver beyond the ditch. <br /> <br />Page3 of 15 <br />
