<br />VIII APPOINTMENTS. <br /> <br />A. In General. New employees shall be selected by the <br />City Council on the basis of their qualifications for <br />the position. Vacancies shall be filled by qualified <br />current employees whenever possible. Whenever a <br />position is vacant or the position holder is absent, <br />the City Administrator may designate an individual to <br />temporarily fill a vacant position as "Acting", except <br />for the position of City Clerk, where the City Council <br />must appoint a deputy clerk. <br /> <br />B. Affirmative Action Policy. No person shall be <br />employed, promoted, demoted, or discharged by the City <br />or in any way favored or discriminated against because <br />of political opinions or affiliations, race, color, <br />creed, religion, national origin, sex, disability, <br />marital status, sexual orientation, or status with <br />regard to public assistance, or because of the exercise <br />of rights under Minn. Stat. Sec. 179A.01 to 179A.25. <br />No person who is over the age of 18 years shall be <br />discriminated against with reference to City employment <br />in any way forbidden by federal or state law. <br /> <br />The City will seek to ensure that all employment <br />practices are free of such discrimination. Such <br />employment practices include, but are not limited to, <br />the following: appointment, promotion, demotion, <br />transfer, layoff, disciplinary action, discharge, <br />compensation, and selection for training, including <br />apprenticeship. <br /> <br />C. Promotion. A department head may ask the City Council <br />to allow the promotion of an employee from the <br />employee I s current position to a similar, more <br />responsible, position in the same or a related <br />department. If the employee's experience and the needs <br />of the City warrant the promotion, the City Council may <br />abolish the current position, establish the more <br />responsible position, and promote the employee into the <br />more responsible position without following the <br />procedures for filling vacant positions. <br /> <br />D. Interim or Acting Appointments. Whenever an employee of <br />the City of Shakopee is required to perform all the <br />duties and responsibilities for a non-union employee <br />whose job classification is determined to be a key <br />employee, the interim employee shall be eligible for <br /> <br />VI II - 1 <br />
