Roberta Wirth, <br />". who has lived in the dev~lop", ' <br />ment for about five years; <br />said the construction compa";' . <br />nyworking on the last phase, <br />of the development is filling <br />the pond with sediment, <br />pumping mud and water into <br />the pond. Wirth, a pollution <br />control specialist with" the <br />MPCA, had it inspected: and, <br />. reported the. construction <br />company is in violation of <br />several MPCA rules. Citing <br />MPCA rules, Wirth said <br />Swift Construction is pump,; <br />ing water and sediment'into: <br />the pond with no sock and no <br />fabric to protect the' inlets. <br />The inlets that did have fabric <br />were filled with mud. Wirth <br />asked council to take action <br />and asked who was responsi- <br />ble for maintaining the pond <br />after construction is com- <br />plete. Wirth wants the pond <br />dredged out immediately. <br />Council took no action on the <br />matter. Mayor Tim Swedberg <br />said if the MPCA and Rice <br />Creek Watershed District'are <br />interested in taking action <br />against the construction cOm- <br />pany, then they should do 'it, H <br />According to Wirth, these' <br />MPCA rules' are frequently <br />violated during new construe, <br />tion. ' ,,' <br />After calling. the Rice <br />Creek Watershed District, <br />Wirth reported the RCWD <br />intends to enforce thell: per- <br />mit and force Swift to clean <br />the pond immediately. The <br />pond is one of two in the <br />development that flows into <br />Hardwood Creek, and .even- <br />tually into Peltier Lake. ,Spe <br />also reported that the compa- <br />ny did not install erosion <br />fences until June 25. <br /> <br />'j .~u ~ <br />
