<br />, <br /> <br />City of Centerville <br />October 23, 2002 <br />Council Meeting Minutes <br /> <br />Mayor Swedberg closed the public hearing at 7: 15 p.m. <br /> <br />Mayor Swedberg opened the public hearing on Ordinance #71 at 7:32 p.m. <br /> <br />Mayor Swedberg said he does not like the Ordinance because the other one said you <br />needed qualifications and this one does not. He then said that anyone could call <br />themselves a tattoo artist and he is concerned about the health and safety of that. <br /> <br />City Attorney Hoeft indicated that he did not know of any licensing requirements for <br />body piercing as it is a relatively new business. <br /> <br />Mr. Silverman indicated that there are schools that train individuals in the art of massage <br />but said the state does not regulate the activities outlined in Ordinance #71. <br /> <br />Council Member Broussard Vickers asked what the questions are with regard to Hair <br />Update. <br /> <br />Mr. Silverman indicated that Ms. Neuman satisfies all of the substantive provisions of the <br />Ordinance with regard to health and sanitation requirements. He then said that the <br />concern is of a financial nature because the Ordinance would require a separate <br />application and license fee for this part of her business. He further suggested that the <br />City should check the language concerning the return of the fees because as it reads it <br />states that the license fee and permit fee are due at the time of application and are not <br />refundable and that could open the City up to a challenge at some point because he does <br />not see how the City could keep the license fee if the application is denied and no license <br />granted. <br /> <br />Mr. Silverman indicated he did not think it was a good idea to require that the license <br />must be given to someone of good moral character. Council indicated that language was <br />to be removed from the document but had been missed. <br /> <br />Mr. Silverman indicated the issue for Ms. Neumann is whether the fees would be more <br />than the revenue generated from that portion of the business. He then asked if there is a <br />way to allow the services that are already being provided as long as the business meets <br />the health and sanitation requirements to be exempt from the application and licensing <br />requirement. <br /> <br />Council Member Broussard Vickers suggested adding wording to include beauty salons <br />that provide ear piercing services. <br /> <br />City Attorney Hoeft indicated that any type of grandfather language would not be <br />allowed because this ordinance is based on public health safety and welfare. <br /> <br />Mayor Swedberg asked if tongue piercing is offered. Ms. Neuman indicated they do <br />pierce tongues but customers sign waivers because the services are unregulated. <br /> <br />Page 4 of 15 <br />
