<br />Subscriber PEG Fee amounts. Pursuant to the terms of the MOU, the amount of <br />the PEG Fee may be increased annually by the CPI. During calendar year 2002, <br />an estimated PEG Fee shall continue to be prepaid to the Commission on a <br />quarterly basis, no later than thirty (30) days prior to the beginning of each <br />calendar quarter. The estimated PEG Fee shall be reconciled annually to reflect <br />actual PEG Fee receipts by the Grantee, subject to more frequent reconciliation <br />ordered by the Commission. Any amounts due to the Commission as a result of a <br />reconciliation shall be paid by the Grantee to the Commission within thirty (30) <br />days following written notice to the Grantee by the Commission of the <br />underpayment. If reconciliation discloses an overpayment by the Grantee, the <br />Grantee may credit the amount of any overpayment against its next quarterly PEG <br />Fee payment. Beginning in calendar year 2003, payments for the PEG Fee <br />pursuant to this subsection shall be made quarterly based on actual receipts from <br />the prior quarter on the same schedule as franchise fee payments. <br /> <br />6.2.2 The Grantee shall provide the fiber-optic or other cabling and other electronics, <br />equipment, software and other materials necessary to transport all PEG signals <br />from their origination point to and from the Commission's master control to the <br />appropriate subscriber network channel, including channels provided discretely. <br />If the Commission's master control continues to be located at 1630 10lst Avenue, <br />NE, Blaine, MN, or ifthe Commission's master control is moved to a location up <br />to 2,500 feet from the I-Net, the Grantee shall provide the aforementioned <br />cabling, electronics, equipment, software and other materials at no cost to the <br />City, the Commission, the North Metro Media Center, I-Net Users, Dark Fiber <br />Infrastructure Users or Additional DFOI Users. Should the Commission re- <br />locate its master control to a location that is more than 2,500 feet from the I-Net, <br />the Grantee shall remain responsible for providing all cabling, electronics, <br />equipment, software and materials necessary to transport all PEG signals from <br />their origination point to and from the Commission's master control to the <br />appropriate subscriber network channel; provided, however, that the Commission <br />agrees to reimburse the Grantee for its Actual Costs in excess of the cost of the <br />first 2,500 feet of construction and installation. The Grantee shall not take any <br />action pursuant to this paragraph until notified, in writing, by the Commission of <br />the intended location of the Commission's master control facility. Once notified <br />by the Commission, in writing, of the intended location of the master control <br />facility, the Grantee shaIl, within thirty (30) days of notification, prepare and <br />tender for the Commission's review a design plan related to the transport, <br />reception and routing of PEG signals to and from the master control facility. A <br />cost estimate shall also be furnished to the Commission, at the same time the <br />design plan is submitted, if the selected master control facility site is not located <br />at 1630 101" Avenue, NE, Blaine, MN or within 2,500 feet of the I-Net. After the <br />Commission has approved the design plan and cost estimate (if applicable), in <br />writing, the Grantee shaIl construct, instaIl and activate all cabling, other <br />electronics, equipment, software and other materials necessary to provide the <br />origination capabilities described in this subsection 6.2.2, such that the <br />capabilities are fully in place and functional prior to operational startup at the <br /> <br />34 <br />
