<br />City of Centerville <br />City Council Meeting <br />May 27. 2009 <br /> <br />Councilmember Lee stated that he agreed with Councilmember Paar. He added that <br />Northland has a substantial history with the City, and they also did a lot more homework <br />than the others regarding what the City needs. <br /> <br />Mayor Capra, Councilmember Broussard Vickers and Councilmember Fehrenbacher <br />concurred and stated that they would also vote for Northland. <br /> <br />Motion bv Council Member Broussard Vickers. seconded bv Council Member <br />Fehrenbacher. to aDPoint Northland Securities as Centerville's Financial Consultant. <br />All in favor. Motion carried unanimouslv. <br /> <br />5. Peltier Lake Drive - Change Order #2 <br /> <br />City Engineer Statz stated that his change order presented at the last meeting was not <br />agreed to by the contractor. He reported that the price for open cut was higher. The <br />revised change order was the directional drilling price. <br /> <br />Motion bv Councilmember Lee. seconded bv Councilmember Paar. to approve <br />revised Chane:e Order #2. as recommended bv City Ene:ineer Statz. All in favor. <br />Motion carried unanimouslv. <br /> <br />vn. NEW BUSINESS <br /> <br />1. Consider Agreement for Testing Services (Soil & Etc.) - 2009 Street Proiect. <br />American Engineering Testing. Inc. <br /> <br />City Engineer Statz stated that this has been discussed over the past few months. Most of <br />the firms have tried to limit liability, but the City objected. The only fIrm that did not limit <br />liability was American Engineering Testing. In the future, the City should consider <br />adopting that language as its generic language and encourage other fIrms to accept that <br />language. City Engineer Statz stated that he is very comfortable with American. He stated <br />that they are excellent at what they do, and their prices are reasonable. <br /> <br />Councilmemher Lee inquired whether other cities allow companies to limit liability. <br /> <br />City Attorney Glaser stated that this is an upcoming trend. <br /> <br />City Engineer Statz stated it is because at one time a lot of engineering fIrms were being <br />sued. <br /> <br />Motion bv Councilmember Fehrenbacher. seconded bv Councilmember Pan. to <br />accept the Ae:reement for Testinl! Services (Soil & Etc.) - 2009 Street Proiect. <br />presented bv American En<Yineerine: Testine:. Inc.. with the condition that the City of <br />Centerville is listed as an additional insured under Commercial General.
