<br />CITY OF CENTERVILLE <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NUMBER 08-XXX <br />A RESOLUTION ADOPTING SPECIAL ASSESSMENT ON IMPROVEMENT <br /> <br />WHEREAS, pursuant to proper notice duly given as required by law, the council has met <br />and heard and passed upon all objections to the proposed assessment for improvement of <br />21't Avenue from a point approximately 600 feet south of Main Street to a point <br />approximately 1,400 feet south of Main Street and continuing on a new unnamed street <br />parallel to Main Street westerly to 20th Avenue, by installation of watermain, sanitary <br />sewer, street pavement, curb, storm sewer and related drainage improvements, <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />CENTERVILLE, MINNESOTA, <br /> <br />I. Such proposed assessment, a copy of which is attached hereto and made a part hereof, <br />is hereby adopted and shall constitute the special assessment against the lands named <br />therein, and each tract of land therein included is hereby found to be benefited by the <br />improvement in the amount of the assessment levied against it. <br /> <br />2. Such assessment shall be payable in annual installments extending over a period of 15 <br />years, the first installment to be payable on or before the first Monday in January, 20010 <br />and shall bear interest at the rate of 5.75 percent per annum from the date of the adoption <br />of this assessment resolution. Each installment shall include interest to December 31, of <br />the year of collection. <br /> <br />3. The owner of any property so assessed may , at any time prior to certification of the <br />assessment to the county auditor, pay the whole or part of the assessment on such <br />property with interest accrued to the date of payment, to the City Administrator, except <br />that no interest shall be charged on any amount paid within 30 days of the adoption of <br />this resolution; and he may at any time thereafter, pay to the administrator the entire <br />amount of the assessment remaining unpaid, with interest accrued to December 31 of the <br />year in which such payment is made. Such payment must be made before November IS <br />or interest will be charged to December 31 of the next succeeding year. <br /> <br />4. The administrator shall file the assessment rolls pertaining to this assessment in the <br />office of the county auditor, such that installments of principal and interest will be <br />collected as due with taxes on each parcel ofland included in the assessment roll. <br /> <br />Adopted by the Council this _ day of <br /> <br />,2009. <br /> <br />Mary Capra, Mayor <br /> <br />Attest: <br />Teresa Bender, City Clerk <br /> <br />21 <br />
