<br />l <br /> <br />g. Street Light Installation. The Developer shall be responsible for the cost of street <br /> <br /> <br />light installation consistent with a street lighting plan approved by the City. <br /> <br />h. Ownership ofImprovements/Pond Maintenance. Upon completion of the work <br />and construction required by this Agreement, the Improvements lying within public easements <br />shall become City property without further notice or action; Developer shaH retain ownership <br />and maintain all ponds and other erosion control measures until adequate ground cover has been <br />established on the Plat including all lots in the Plat, at which time the ponds shall become City <br />property without further notice or action. However, the Developer shall maintain ponds until the <br />development is complete in conformance with this agreement, and provided that the engineer for <br />Developer shall certify that the ponds have been cleaned and provide the designed holding <br />capacity, prior to the city taking over responsibility for any ponds in the development. <br /> <br />I. City's financial participation in oversizing of utilities. The City shall participate <br /> <br /> <br />in the cost of the utilities needed for ovcrsizing the water. Developer shall include this work in <br /> <br /> <br />the construction contract for the Public Improvements. The City will reimburse the Developer <br /> <br />for these costs, based upon the actual unit prices contained in the City's most recent construction <br /> <br />project.
