Literal interpretation of the provisions of this Ordinance would <br />deprive the petitioner of rights commonly el\ioyed by other <br />properties in the same district under the terms of this ordinance. <br />3. Granting the variance requested will not confer on the applicant <br />and special privilege as denied by this ordinance or to other lands, <br />structures or buildings in the same district. <br />4. The proposed variance will not impair an adequate supply of Iight <br />in the air of the adjacent property, umeasonably diminigh or impair <br />established property values within the SlDTOunding area or in any <br />other respect impair the public health, safety or welfare of the <br />residents of the City. <br /> <br />The Chair requested comment on each individual criterion. Brief comments took place <br />that the property and existing building met the existing Ordinance #4 criteria for <br />requesting a Variance and consensus was to approve DCS Properties' Variance request. <br /> <br />Motion by Member Kilian and seconded by Member Braioard to close the Public <br />Hearing. Motion carried lInan1mously. <br /> <br />Mr. March reported that the developer of Hunter's Crossing (Mr. Richard S. Carlson" <br />Associates) is requesting that the property lying southward of LaMotte Park (previously <br />owned Pracher and Bauman properties) be allowed to be developed in the year 2000 <br />instead of the proposed 2001 development quadrant contained in the. City's <br />Comprehensive Plan. Mr. Carlson has proposed to provide the City with an additional <br />$5oo/lot (37 lots) in Park Dedication Fees. Mr. March reiterated that the Commigsjon's <br />consideration of the MUSA Re-classification and any action made by same should be <br />conditioned upon three other entity's approval besides the City's; the City ofLino Lakes, <br />Anoka County and the Metropolitan Council. Mr. March also stated that Mr. Carlson <br />must come before the Commission again to request Final Plat Approval. <br /> <br />The Commission questioned if the City's Engineer and Mr. PaJzer (Building <br />Officia1lPublic Works) had reviewed the presented material. Mr. March stated that both <br />bad reviewed. <br /> <br />Motion by Member DeVine. seconded by Chair Hanmn to close the Public Hearing for <br />consideration of Richard S.
