<br />y <br /> <br />MEMO <br /> <br />DATE: <br /> <br />May 16,2002 <br />Honorable Mayor and Council Members <br />Mary Capra <br />CooleCo~onUpoote <br /> <br />TO: <br />FROM: <br />RE: <br /> <br />...................................................................................... <br /> <br />Please find attached the find attached Resolution 2002-02 Order to Cease and Desist by North Metro <br />Telecommunications Commission and the response from Mr. David Seykora of AT&T Broadband. <br /> <br />Actions Taken: <br /> <br />. Resolution No. 2002-02 cease and desist order was given to ATT &T broadband <br />April 18, 2002 for ATI&T broadband to stop using the arbitration clause in their <br />customer service agreement. <br /> <br />. May 3, 2002 letter received from Mr. Seykora regarding ATT&T customer policy and <br />their reasoning behind their belief they are within the law to request arbitration. <br /> <br />. Cable Commission motion was to allow staff to find AT&T Broadband in non- <br />compliance with the franchise agreement, if the company does not fully comply with <br />the Cease & Desist order by May 18, 2002. This Will include the issuance of notice <br />of violation and the invocation of applicOOle remedies. <br /> <br />. The Coole Commission agrees to participate in comments to the FCC regarding the <br />removal of franchise fees from high-speed cable modems. The cities want to have <br />their voices heard because any FCC rule rnHking could affect the rights of way <br />management and future income from cOOle modem service. The commission agree to <br />not exceed two thousands dollars to support this effort. <br /> <br />Future Actions: <br /> <br />· The city will be receiving a request shortly to free up the permits for AT&T <br />broadband to upgrade the system. AT&T broadband will agree to work with the <br />cities public works and engineering firms in an effort to make the work flow <br />smoothly. This will be coming to council for approval within the next three to four <br />weeks. The commission feels they are close enough to agreement on the contract to <br />allow upgrading to begin. <br />
