<br />Council asked that the equipment be picked up during business hours to avoid overtime <br />costs. <br /> <br />IX. OLD BUSINESS <br /> <br />1. Mr. Dennis Shudv - Cedar Street Park <br /> <br />City Attorney Hoeft indicated that he reviewed and revised the Purchase Agreement. <br /> <br />Motion bv Council Member Capra, seconded bv Council Member Broussard <br />Vickers to approve the purchase al!:reement and authorize the Mavor to sil!:D on <br />behalf ofthe City. All in favor. Motion carried unanimouslv. <br /> <br />2. Mr. Peter (Clav) Alcock. 1806 Main Street (Mill Road Extension Vacation) <br /> <br />Mr. Alcock indicated that he would like to have Council vacate the Mill Road extension <br />since it does not appear that the road will be extended. <br /> <br />Mr. Cordell, Mr. Alcock's brother-in-law, indicated that due to Mr. Alcock's physical <br />disabilities he and his wife assist him with a lot of things around his home and property. <br />He then said that there has been an ongoing dispute between Mr. Alcock and his neighbor <br />concerning this piece of land and having the City vacate the property will hopefully <br />resolve the issue. <br /> <br />City Attorney Hoeft indicated that, if the City determines it does not need the property for <br />a public purpose and Council agrees, a public hearing on the vacation can be set. <br /> <br />Mr. Palzer indicated that there are no utilities in the area and the City does not need the <br />property. <br /> <br />City Attorney Hoeft clarified that all the City will do is vacate that property and it is by <br />operation of law as to how the property is divided and that is a private matter between the <br />parties. <br /> <br />Ms. Moore-Sykes indicated that it appears that the property abuts waters of the state so a <br />30 day notification to the DNR is required. <br /> <br />Mr. Alcock's attorney presented a survey map and Mr. Hoeft determined that no <br />notification to the DNR was required. <br /> <br />Council asked Staff to set a public hearing for the first meeting in April. <br /> <br />3. Fee Schedule 04-007 <br /> <br />Ms. Moore-Sykes reviewed the changes made to the fee schedule and indicated the five <br />(5%) percent increase for Staff time had been added as requested. <br /> <br />Page 7 of 12 <br />
