<br />to upgrading nonconforming systems: <br /> <br />I. A systematic review of existing records to determine which systems in the jurisdiction are <br />nonconforming and requiring reconstruction when practicable; <br /> <br />2. A systematic on-site inspection program including all properties where adequate record of <br />conformances does not exist, identifYing nonconforming or illegal systems and requiring <br />reconstruction when appropriate; or <br /> <br />3. A notification or education program that is oriented toward convincing substantial numbers <br />of property owners to evaluate their sewage systems and voluntarily upgrade the sewage treatment <br />system, if appropriate. <br /> <br />No later than the date of adoption of compliant shore land regulations, a community must submit a <br />formal resolution to the commissioner indicating which of the above three options the community <br />has selected. The commissioner can accept other programs if they are justified by the local unit of <br />government. <br /> <br />SECTION 7.0 - SUBDlVISION/PLATTING PROVISIONS <br /> <br />A community must adopt, at a minimum, the subdivision and platting provisions of this Section of <br />the sample ordinance. A community must demonstrate that it has a legally enforceable mechanism <br />to administer these procedures, standards and criteria. A community must submit a copy of its <br />subdivision regulations to the Department of Natural Resources prior to receiving state approval <br />that the community's overall shore1and regulations are in compliance with Minnesota Regulations, <br />Parts 6120.2500 - 6120.3900. <br /> <br />SECTION 8.0 - PLANNED UNIT DEVELOPMENTS <br /> <br />Local governments must consider incorporating provisions allowing planned unit developments <br />(PUD's). If a community chooses to allow PUD's, they may be allowed for new projects on <br />undeveloped land, redevelopment of previously built sites, or conversions of existing buildings and <br />land. These PUD provisions must be consistent with or more restrictive than the provisions of <br />Section 8.0. At such time as the commissioner approves the local government's shore land <br />regulations, PUD approval would be the sole responsibility ofthe local government. Also, please <br />note that the Department of Natural Resources has developed a PUD Evaluation Worksheet to aid <br />in the administration of these provisions, which is available upon request. <br />
