<br />City ofCenterville City Council Meeting October 9, 1996 <br /> <br /> <br />APPEARANCES: <br />Representative for Don Opp - Heidi and Randy Gnadke of 7124 Progress Rd #9, they <br />presented and read a letter to the council. (See Attached) <br /> <br />Mayor Wilharber acknowledged receipt of the letter. <br /> <br />UNFINISHED BUSINESS: <br />Bonding Clearwater Meadows - Sid Inman of Ehlers and Associates explained the <br />bonding process and suggested combining the Clearwater Meadows bond and refunding <br />the 1991 improvement <br /> <br />MOTION by Helmbrecht, seconded by Brenner to do as the letter dated October 9, <br />indicates. Motion carried unanimously. <br /> <br />MM Home builders - Rick Lewandowski and Jim Barker requested the council to lift the <br />stop work order on 7008 Brain Drive. Lewandowski explained the elevation grade was <br />tainted due to E.J. Rud surveying which indicated the wrong grade. Therefore the garage <br />floor was laid at the indicated grade. Further, the 65 year old home buyers were pleased <br />with the minimal stairs leading into the home. Lewandowski explained the grade was at <br />8.2% which is within a foot of the requirements. MM home builders would appreciate <br />lifting the stop work order as they have a closing date they're hoping to meet. Paul Palzer, <br />Building Official, indicated the garage is 1.7 feet above grade at 11.4% which does not <br />comply with the grading plans approved by the council. Further, there could be potential <br />problems with the grade of the driveway. Wilharber indicated Palzer was doing his job <br />requiring the builders to comply with the grade plans. Lewandowski stated, of the lots, 28 <br />have a 10% grade, since the home has been sold to an elderly couple who like the grade as <br />is could the grade remain. March commented he had spoke with Rockey Goertz and he <br />does not want one home a foot higher than the others. Nyberg stated the grade is fine but <br />the council approved the grading plan and Paul is holding all the builders to the plans. <br />Palzer stated the builder originally requested a 10.5% elevation which was denied. Palzer <br />had sent back the certification of survey and with red pen indicated a elevation of9.11 <br />would be acceptable. Lewandowski requested the city to lift the stop work order - it was <br />an honest mistake, he did not do it intentionally. Further, with the surrounding grade <br />requirements the neighboring homes will be similar plus the home is sold. Wilharber <br />questioned Hellings on the legalities. Hellings stated if the city approves this grade and <br />another builder requests a grade change this city will not have too many options. <br /> <br />MOTION by Brenner, seconded by Powers-Rasmussen to deny the request to lift the stop <br />work order. Motion carried unanimously. <br /> <br />Vacation of Erkenbrack's property - Resolution 96-33 Wilharber asked Hellings his <br />opinion. Hellings stated the resolution had his approval. <br /> <br />MOTION by Helmbrecht, seconded by Brenner to approve resolution 96-33. Motion <br />carried unanimously. <br /> <br />2 <br />
