FiL E COpy RESOLUTION 96-33 RESOLUTION APPROVING THE V ACA TION OF PROPERTY WHEREAS, the Centerville City Council, on its own Motion, proposed to vacate approximately 200 by 33 feet of Mill Road laying north of its intersection with Peltier Circle; described as follows: EASTERLY OF LOTS 1 AND 2, BLOCK 5, NORTH TO SOUTH, 200 FEET BY, EAST TO WEST, 33 FEET OF SAID PROPERTY LOCATED IN PELTIER LAKE HilLS ADDITION. Except easement rights for public utility and drainage purposes. WHEREAS, a public hearing with respect to said vacation was set for October 1, 1996 in accordance with Minnesota Statues; and, WHEREAS, a Notice of Publication of said hearing was publisb,ed and posted two weeks prior to the meeting of October 1, 1996; and, WHEREAS, the Planning Connnission did hold a Public Hearing on October 1, 1996 to inform any and all interested persons relevant to the vacation of said permanent trailway easement; and, WHEREAS, it was determined by the City Council that said permanent trailways as described above is not needed for trailway purposes; and, WHEREAS, the Centerville City Council reserves easement rights for utility and drainage purposes over, under and across said vacated property. NOW, THEREFORE, BE IT RESOLVED, by the City ofCenterville, Anoka County, Minnesota, that the perpetual easement of Mill Road laying 200 by 33 feet northwest of intersection with Peltier Circle described below is hereby vacated. EASTERLY OF LOTS I AND 2, BLOCK 5, NORTH TO SOUTH 200 FEET, EAST TO WEST BY 33 FEET OF SAID PROPERTY LOCATED IN PELTIER LAKE IDLLS ADDITION. Except easement rights for public utility and drainage purposes. RESOLUTION, was passed this 9th day of October, 1996.
