Closing & Serving of Intoxicating Liquor or 3.2 Percent Malt <br />Liquor Renewals (Kelly's Komer & Trio Inn) <br /> <br />DATE: <br /> <br />June 18, 2004 <br /> <br />Last year, Council approved the 2 AM. Closing and Serving for both Kelly's Komer & <br />Trio Inn last year. Mr. Vanderbeek, owner of Wiseguy's Pizza and Pub was not <br />interested in applying for this option last year. <br /> <br />Both establishments have submitted documentation and request council's consideration, <br />granting and authorizing the City Clerk to sign the Renewal Applications for Optional <br />Liquor 2AM Applications again this year. <br /> <br />I have attached excerpts of last year's meeting minutes, Minnesota State Statute <br />340A504, Subd. 7; excerpt from the Minnesota Department of Public Safety Alcohol and <br />Gambling Enforcement Division's Introduction to Minnesota Liquor Laws and Rules, <br />Page 8 & 9, IV Hours & Days of Sale, D & F and Page 11, vn. Restrictions, H; and <br />Ordinance #13, Section 19. Hours aud Days of Sale for your review. <br /> <br />On June 16,2004 I spoke with Mr. Vanderbeek via the telephone and questioned whether <br />he would be applying for this Optional Renewal, Mr. Vanderbeek stated that he would <br />decline. <br /> <br />I spoke with Deputy Police Chief Bob Makela in an attempt to ascertain whether there <br />was a statistical increase in calls to either Kelly's Komer or Trio Inn during the licensing <br />period of July 1, 2003 to June, 2004 and July 1, 2002 to June 2003. Please find the <br />attached information. Deputy Chief felt that statistically, the figures do not reflect any <br />significant change in calls. Deputy Chief also cautioned that these are only calls to the <br />street address of both establishments. Deputy Chief Makela also stated that the Police <br />Department is 24 hours per day, 7 days a week and does not have a recommendation on <br />this issue. <br />
