The City <br />appreciates the fact that you mowed your yard prior to receipt of the letter. However, the <br />City requests that you trim around the foundation of your home and garage, shed, trees, <br />mailbox and etc. also adhering to the ordinance in all respects as to the length of the <br />grass. The City requests that you abate this violation within five (5) days of receipt of the <br />letter (August 6, 2004). <br /> <br />I would like to point out the fact that the previous letter that was sent to you granted you <br />thirty (30) days to abate the violations; grass height and the wood pile, which deviated <br />from Ordinance #54. Council has directed staff to follow the abatement process outlined <br />in Section 5 of the ordinance reads: Abatement. Whenever the officer charged with <br />enforcement determines that a public nuisance is being maintained or exists on the <br />premises in the City, the officer shalllWtify in writing the owner/occupant of the premises <br />of such fact and shall order that said rmisance be terminated and abated The notice <br />shall be served in person or by certified or registered mail. The notice shall specify the <br />steps to be taken to abate the rmisance and the time; not exceedingfive (5) days, within <br />which the rmisance is to be abated Such notice shall also state that in the event ofnon- <br />compliance, abatement will be done by the City of Centerville at the owner's expense. <br />When no owner, occupant or agent of the owner can be found, notice shall be sent by <br />registered mail to the person who is listed on the records of the county auditor or county <br />treasurer as the owner; service will be complete with mailing. /fnotice is not complied <br />with within the time specified, the enforcing officer shall abate the nuisance. <br /> <br />Ordinance #54, Section 7 of the ordinance reads: Appeal. AIV' person aggrieved by a <br />decision of the enforcing officer or his assistants, m~ appeal that decision to the City <br />Council by filing a written request with the enforcing officer, or his assistants, within five <br />(5) days of service of the notice provided herein. The enforcing officer, or his assistants, <br />shall within five (5) days cause the appeal to be placed on the next regular City Council <br />agenda and shall notify the appellant of the date, time, and place of such meeting.
