'Fa;\( (651) 429.8629 July 30, 2004 Ms. Brenda Hayne 1832 Hayfield Road Centerville, MN 55038 Dear Ms. Hayne: You recently received a letter requesting you to abate/mow your lawn. The City appreciates the fact that you mowed your yard prior to receipt of the letter. However, the City requests that you trim around the foundation of your home and garage, shed, trees, mailbox and etc. also adhering to the ordinance in all respects as to the length of the grass. The City requests that you abate this violation within five (5) days of receipt of the letter (August 6, 2004). I would like to point out the fact that the previous letter that was sent to you granted you thirty (30) days to abate the violations; grass height and the wood pile, which deviated from Ordinance #54. Council has directed staff to follow the abatement process outlined in Section 5 of the ordinance reads: Abatement. Whenever the officer charged with enforcement determines that a public nuisance is being maintained or exists on the premises in the City, the officer shalllWtify in writing the owner/occupant of the premises of such fact and shall order that said rmisance be terminated and abated The notice shall be served in person or by certified or registered mail. The notice shall specify the steps to be taken to abate the rmisance and the time; not exceedingfive (5) days, within which the rmisance is to be abated Such notice shall also state that in the event ofnon- compliance, abatement will be done by the City of Centerville at the owner's expense. When no owner, occupant or agent of the owner can be found, notice shall be sent by registered mail to the person who is listed on the records of the county auditor or county treasurer as the owner; service will be complete with mailing. /fnotice is not complied with within the time specified, the enforcing officer shall abate the nuisance. Ordinance #54, Section 7 of the ordinance reads: Appeal. AIV' person aggrieved by a decision of the enforcing officer or his assistants, m~ appeal that decision to the City Council by filing a written request with the enforcing officer, or his assistants, within five (5) days of service of the notice provided herein. The enforcing officer, or his assistants, shall within five (5) days cause the appeal to be placed on the next regular City Council agenda and shall notify the appellant of the date, time, and place of such meeting.
