<br /> <br />tervi[[e <br />'Esta6{isfied 1857 <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />January 28, 2004 <br /> <br />TO: <br /> <br />Honorable Mayor and Councilmembers <br /> <br />Kim Moore-Sykes, City Administrator~ <br /> <br />Ordinance #75, An Interim Ordinance Adopting a Moratorium on <br />Slaughter House/Butcher Shop Operations in Any Zoning District Within <br />the City of Centerville. <br /> <br />FROM: <br /> <br />RE: <br /> <br />............................................................................ <br /> <br />Ordinance #75 was adopted on February 12, 2003 as an interim ordinance to provide the <br />City and Staff an opportumty to review Ordinance #4 provisions in response to the <br />request by an applicant to be allowed to open a custom slaughter house and butcher shop. <br />This review would also include considering additional provisions to Ordinance #4 that <br />regulate this use and to review studies and additional information from other cities. <br /> <br />Currently, the !,lnly zoning district that allows feed lots and related agricultural uses such <br />as slaughter houses, butchery, animal products processing, etc., is currently R-l. <br />Ordinance #4 also stipulates that such agricultural uses can only occur on parcels of 10 <br />acres or more. Because of the amount and pace of residential development, there are <br />very few parcels that currently conform to those regulations established for R-1. <br /> <br />Due to development, Centerville is becoming less agricultural and more urban in nature. <br />Four parcels, 7357 - 20th Avenue, 7384 Old Mill Road, 7386 Old Mill Road, and 6756 <br />CentervilleRoad are designated as R-1, are 10 acres or more in size and agricultural uses <br />are permitted. Other R-l designated parcels are located on 21" Avenue but these parcels <br />are less than 10 acres and are considered non-conforming. <br /> <br />Other parcels in Centerville that are 10 acres or more exist in the Industrial zoning district <br />and if a slaughter house/butcher shop requested to located in this area, the owner would <br />need to apply for rezoning. This could be considered as 'spot zoning' and the City has a <br />precedent for denying rezoning requests if spot zoning is the result. <br /> <br />Most of these aforementioned R-1 parcels have wetlands or other waterways, making <br />them environmentally sensitive to any farming or other agricultural uses. Staff <br />recommends that language be added to Ordinance #4 to protect wetlands that may exist in <br />any R-1 zoning district. Additional examples of this language could include: <br /> <br />1.
