<br />Lawful Gambling Highlights <br /> <br />1. What is lawful gambling? <br /> <br />? <br />. <br /> <br />State law defines lawful gambling as the "operation, conduct or sale of bingo, <br />raffles, paddlewheels, tipboards, and pull-tabs." As used in state statues, the <br />term lawful gambling does not include Indian gaming, the state lottery or pari- <br />mutuel betting. <br /> <br />2. Who may conduct lawful gambling? <br /> <br />State law authorizes fraternal, religious, veterans' or other non-profit <br />organizations to conduct lawful gambling. <br /> <br /><9 <br /> <br />3. Can cities conduct lawful gambling? <br /> <br />No. Cities are not authorized by law to conduct lawful gambling. <br /> <br />4. Can organizations that conduct lawful gambling <br />spend the profits on anything they please? <br /> <br />$ <br /> <br />No. Profits from lawful gambling may only be used to pay the organization's <br />allowable expenses and for other purposes authorized by the state gambling <br />law. Lawful purposes for which profits may be expended include certain types <br />of charitable contributions. <br /> <br />5. Who licenses lawful gambling organizations? <br /> <br />The State of Minnesota licenses lawful gambling organizations through the <br />Gambling Control Board. The Board will not grant a license unless the <br />organization also obtains a premises permit issued by the Board. The Board <br />will not grant or rcncw a premises permit unless the organization submits a <br />resolution from the city approving the permit. <br /> <br />6. Can a city regulate lawful gambling? <br /> <br />Yes. Cities are authorized to regulate lawful gambling. Under state law, cities <br />may: <br />. Prohibit lawful gambling; <br />. Regulate the days and times when lawful gambling may occur; <br />. Regulate where lawful gambling may occur; <br />. Require a local permit for the conduct of lawful gambling excluded <br />from state licensing requirements; <br />. Require lawful gambling organizations to make specific expenditures <br />of profits from gambling; <br /> <br />Lawful Gambling 5 <br />
