<br />LEAGUE OF MINNESOTA <br />CITIES MODEL <br />ORDINANCE <br />REGULATING LAWFUL <br />GAMBLING <br />(May 2002) <br /> <br />Before adontin!! this ordinance. a city <br />should he familiar with the contents of <br />Lea!!ue memo "Lawful Gamhlin!! Notes <br />and Ordinances" LMC 255.7 (Mav 2002). <br /> <br />INTRODUCTION AND <br />INSTRUCTIONS: <br /> <br />This model lawful gambling ordinance <br />contains a number of provisions a city may <br />wish to enact. A city wishing to adopt this <br />ordinance should review it with the city <br />attorney to detennine which model <br />ordinance provisions are suited to the city's <br />circumstances. A city can modify the <br />ordinance by eliminating provisions on <br />activities it does not seek to regulate. <br />Because most of the provisions ofthis <br />ordinance are controlled by statute, the city <br />attorney should review any modifications to <br />make sure they conform to state law. ill <br />addition, the city attorney should review the <br />entire ordinance before it is adopted because <br />it establishes rights and responsibilities of <br />both the city and of the license applicants <br />and holders. <br /> <br />This model ordinance is drafted in the form <br />prescribed by Minnesota Statutes Section <br />412.191, Subdivision 4, for statutoI)' cities. <br />Home rule charters often contain provisions <br />concerning how the city may enact <br />ordinances. Home rule charter cities should <br />consult their charter and city attorney to <br />ensure the city complies with all charter <br />provisions. <br /> <br />Lawful Gamblibg <br /> <br />This ordinance will affect existing gambling <br />licensees. Therefore, a copy of the proposed <br />ordinance should be mailed to each licensee <br />along with a notice of hearing on the <br />ordinance to inform the licensees of the <br />contents of the proposed ordinance and to <br />give them an opportunity to make their <br />views known. <br /> <br />AN ORDINANCE <br />AUTHORIZING AND <br />REGULATING THE <br />CONDUCT OF LAWFUL <br />GAMBLING WITHIN THE CITY <br />OF <br /> <br />MINNESOTA <br /> <br />THE CITY COUNCIL OF THE CITY <br />OF DOES <br />ORDAIN: <br /> <br />Section 1. ADOPTION OF STATE LAW <br />BY REFERENCE <br /> <br />The provisions of Minnesota Statutes, <br />Chapter 349, as they may be amended from <br />time to time, with reference to the definition <br />of terms, conditions of operation, provisions <br />relating to sales, and all other matters <br />pertaining to lawful gambling are hereby <br />adopted by reference and are made a part of <br />this ordinance as if set out in full. It is the <br />intention of the Council that all future <br />amendments of Minnesota Statutes, Chapter <br />349, are hereby adopted by reference or <br />referenced as if they had been in existence at <br />the time this ordinance was adopted. <br /> <br />Section 2. CITY MAY BE MORE <br />RESTRICTIVE THAN STATE LAW <br /> <br />The council is authorized by the provisions <br />of Minnesota Statutes, Section 349.213, as it <br />may be amended from time to time, to <br />impose, and has imposed in this ordinance, <br />additional restrictions on gambling within its <br />limits beyond those contained in Minnesota <br /> <br />17 <br />
