Again, Michael D. Johnson attended the hearing for the <br />proposed street improvements for Brian Dr.on Thurs. JaIL 29, 2004. When Michael tried to address the council <br />regarding proposed improvements that affeet our property at ( 7046 Brian Dr.) , Acting Mayor -Council Member <br />Linda Broussard Vickers said , "You will not be able to speak. As we have already spoken about your "Special <br />Situation", any thing you want to say has to be put in writing." On Feb. 08,2004 we sent our first letter of protest. <br />We put one in the City Hall mailbox and sent another copy E-mail. We were told that they were never receivedt So <br />we sent another copy to City Hall and a copy to Mary Capra -Council member. On May 26,2004 a third letter along <br />with two picture boards that revealed befure and after shots of the last improvements to said property were brought <br />to city Hall for the May 26, 2004 Council Meeting, for Mary Capra- Councilmember to present to the Council in <br />. -:c.: :::;-: the event:that-we:COUld.notgeHotbe CounCIl meetlllg:m.ttme:.Maty,lOapra S31dthatshe:would-have:the:Bnanlli.cc:cccc:--:: <br />topic moved to last on the agenda. That we should come as soon as possible. Sbe stated, that there was a10t on tbe <br />agenda and she thought the meeting would go late, maybe to eleven o'clock. She also stated that she would only be <br />there to nine o'clock. We arrived at ten to nine o'clock. We found four people in the parking lot. We introduced <br />ourselves to Kim Moor-Sykes, City Administrator aod to City Attorney Jeff Hoeft. They informed us that the meeting <br />was over. That they too thought it would go late, but in fuet the meeting was over early. Jeff Hoeft excused himself <br />and we continued speaking to Kim Moor-Sykes expressing to her our disagreement with the proposed improvements <br />to Brian Dr.. She informed us that the project is going ahead and that the City Engineer- Tom Peterson made a <br />diagram showing the council that be proposed to come into the easement on our property 100 to 150' removing all <br />the improvements that have already been made, extending as fur as the center of the creek on the road way. Again we <br />oppose this proposal and any assessments regarding the 2004 Brian Drive Street Improvement Project as the <br />proposed improvements to this side of Brian Drive have already been 1l1ade up to and all parts that affect our property <br />and it needs to be further noted that the improvements made are correct and functioning properly as fur as all <br />drainage issues go. We have a new culvert over Clearwater Creek. Elevation and the Grade have been changed, new <br />corb and gutter installed, Water has been brought up imo our property and stubbed, A new Sewer aod Storm drain <br />are installed. Any further changes to the already existing new improvements to our property WILL NOT <br />"BENEFIT" our property in any way! AGAIN all the issues City Engineer- Tom Peterson brought up to us deal with <br />the other side of the street including the drainage issues. We bearby request again for our side of the street to be left <br />alone, aoy removing of said improvements that have already been made on our side is a waste of money and very <br />detrimental to our property and the neighborhood as a whole as currently our side of the street is straight and <br />appealing to the eye from one end of the street as well as the other. And we have no drainage issues. See Minnesota <br />Statute 429.051, If you proceed and remove our said improvements, you the city are responsible for all costs incurred <br />for this new pr'!iect as the new proposed improvement pr'!iect does not benefit 7046 Brian Dr. Centerville, Mn. <br />E~sed are copies of all letters that have been sent to the City. <br /> <br />Sincerely <br /> <br /> <br />een M.
