<br />NJ".,.".""".,..",'e""'"'",,tll <br />. , ,.',", <br />" '. .'. -' -: :', .' <br />> i i ;:0..,. <br /> <br />TO: Honorable Mayor and Council Members <br /> <br />FROM: Teresa Bender, City Clerk <br /> <br />SUBJECT: Planning and Zoning Recommendation (Swenson - 7016 Brian <br />Court Shed Extension) <br /> <br />DATE: May 7, 2004 <br /> <br />As Council is aware, the Swenson's have been before you in November, 2003 and <br />requested that they be allowed an extension to move their shed from the <br />drainage/utility easement and encroachment in the side yard setback. <br /> <br />Mr. Swenson requested to appear before Planning and Zoning on May 4, 2004 <br />and requested that they again be allowed an extension to move their shed. <br /> <br />Below is an excerpt from the meeting minutes: <br /> <br />1. Mr. Joel Swenson -7016 Brian Court - Shed Extension - DrainagelUtility <br />Easement <br /> <br />Mr. Swenson addressed the Commission and explained that his yard is very wet <br />and he would like an extension to move the shed or, if at all possible, permission <br />to leave the shed in its existing location within the drainage easement but move it <br />to comply with the setback requirements. <br /> <br />Mr. WiIharber indicated that the shed is in a good location in the yard and, if the <br />water were to get as high as the shed, the houses in the area would be flooded. He <br />then said that it is sometimes necessary to approve variances because not all <br />situations fit the code requirements. <br /> <br />The Commission discussed the situation with Mr. Swenson, including his <br />drainage problems alleged to have been caused by the neighbor, and determined <br />that there is not a way to allow the shed to remain in its present location. <br /> <br />Mr. Swenson indicated that, if the shed cannot remain where it is then he would <br />like an extension until the ground dries out or freezes to make moving the shed <br />easier. <br />
